I <br /> 1-07.23 Public Convenience and Safety <br /> Delete the last sentence of the first paragraph of 1-07.23 and substitute the following: 111Nothing contained in this Contract is intended to create any third-party beneficiary <br /> rights in favor of the public or any individual utilizing the facilities being constructed or <br /> improved under this Contract. <br /> 1-07.23(1) Construction Under Traffic <br /> Supplement 1-07.23(1) by adding the following after item 5 in the second paragraph: <br /> Because of high traffic volumes on Rucker Avenue weekday lane closures are not <br /> allowed. Work crossing Rucker Avenue will have to be scheduled nights or <br /> weekends in accordance with 1-08.0(2) HOURS OF WORK. <br /> Maintain a minimum of one lane remaining open to traffic along 35th Street and <br /> Rainier Avenue at all times. <br /> If Engineer determines the permitted closure hours adversely affect traffic, the <br /> Engineer may adjust the hours accordingly. The Engineer will notify the <br /> Contractor in writing of any change in the closure hours. <br /> No lane closures will be allowed on a holiday or holiday weekend, or after 12:00 <br /> p.m. on a day prior to a holiday or holiday weekend. A holiday weekend is defined <br /> as having a holiday fall on Friday, Saturday, Sunday or Monday. <br /> Provide a uniformed off-duty Police Officer to control traffic in critical situations as <br /> determined by the Engineer. The uniformed officer shall be paid under contract <br /> item "Traffic Control— Off-Duty Police Officer." I <br /> Notify the local Fire, Police and Engineering Departments before the beginning of <br /> each phase of construction so that these agencies may re-route their emergency <br /> vehicles around the construction zone. The non-emergency phone number for <br /> Everett Police is 258-2484, for Fire Dispatch is 257-8757, and for Public Works 111 <br /> Engineering is 257-8800. <br /> Notify City of Everett Transit at 425-257-8984 and Community Transit at 425-348- <br /> 7100 <br /> of all street closures or delays at least 24 hours in advance to enable <br /> rerouting of buses. <br /> Notify the property owners at least 72 hours in advance to enable them to remove <br /> vehicles parked in the vicinity of Work. Towing vehicles shall be the responsibility of <br /> the Contractor and no additional payment will be made. <br /> Further supplement 1-07.23(1) by adding the following: <br /> 1-07.23(1)A General Requirements Traffic <br /> The following general requirements apply to all Work on the Project: <br /> Prepare and submit to Engineer a Traffic Control Plan in accordance with 1- <br /> 10.2(2) TRAFFIC CONTROL PLANS. <br /> Refer to 1-08.4(2) SPECIAL CONSTRUCTION CONSTRAINTS regarding <br /> construction constraints resulting from traffic control. <br /> Notify all affected property owners prior to commencing the barricading of <br /> streets, sidewalks and driveways. <br /> All business driveways shall remain open except as necessary to permit <br /> curing of construction materials or for short periods of time as required for <br /> excavations.
