1 <br /> f � <br /> 1 ORDINANCE NO. 9'‘ P—? <br /> 2 <br /> AN ORDINANCE assuming full and complete management and control of <br /> 3 that portion of the entire Mukilteo Water District not included <br /> within another city. <br /> 4 <br /> 5 <br /> WHEREAS, the City of Everett commencing in January 1, 1958, and continuing <br /> 6 <br /> to date has annexed substantial territory of the Mukilteo Water District (hereafter <br /> 7 <br /> called the "District"); and <br /> 8 <br /> WHEREAS, the City of Everett to date has annexed portions of the Mukilteo <br /> 9 <br /> Water District equal to at least 60 percent of the assessed valuation of the real <br /> 10 <br /> property lying within such District; and <br /> 11 <br /> WHEREAS, the City of Everett hereby finds that the City of Everett should <br /> 12 <br /> assume jurisdiction of the District and that all real and personal property, franchises, <br /> 13 <br /> rights, assets, taxes levied but not collected for water and sewer lines, and all other <br /> 14 <br /> facilities and equipment of the District should become the property of the City of <br /> 15 <br /> Everett subject to all financial, statutory or contractual obligations of the District for <br /> 16 <br /> the security or performance of which such property may have been pledged; and <br /> 17 <br /> WHEREAS, the City of Everett finds that assumption of jurisdiction of the <br /> 18 <br /> District is in the best interest of the economical and efficient management of both the <br /> 19 <br /> City of Everett water system and the Mukilteo Water District and that customers of <br /> 20 <br /> the District will receive equal or better service from the City of Everett now and in the <br /> 21 <br /> future; <br /> 22 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 23 <br /> Section 1: The City of Everett hereby assumes jurisdiction of the Mukilteo <br /> 24 <br /> Water District, and the City of Everett shall hereafter own all real and personal <br /> 25 <br /> property, franchises, rights, assets, taxes levied but not collected for the District for <br /> 26 <br /> other than indebtedness, water and sewer lines, and all other facilities and equipment of <br /> 27 the District, subject to all financial, statutory or contractual obligations of the District <br /> 28 <br /> for the security or performance of which such property may have been pledged. <br /> 29 Section 2: The City of Everett, in addition to its other powers, shall manage, <br /> 30 control, maintain and operate such property, facilities and equipment and fix and <br /> 31 collect service and other charges from owners and occupants of property to be served <br /> 32 <br />
