1 by the City, subject however to any outstanding indebtedness, bonded or otherwise, of 2 the District payable from taxes, assessments or revenues of any kind or nature and to 3 other contractual obligations of the District. 4 Section 3: The City of Everett hereby assumes the obligation of paying such 5 District indebtedness and shall levy and cause to be collected such District taxes, 6 assessments and utility rates and charges of any kind or nature to pay and secure the 7 payment of such indebtedness according to all the terms and conditions and covenants 8 incident to such indebtedness and shall assume and perform all outstanding contractual 9 obligations of the District in accordance with the terms, conditions and covenants 10 thereof. During the period until the outstanding indebtedness of the District has been 11 discharged, the territory of the District and the owners and occupants and property 12 therein shall continue to be liable for its and their proportionate share of such 13 indebtedness, including any outstanding assessments levied with any local improvement 14 district or utility local improvement district thereof. The City assumes the obligation 15 of causing the payment of such indebtedness, collecting such taxes, assessments and 16 charges and serving and performing the other District contractual obligations. 17 Section 4: The City Council of the City of Everett shall act as the officers of 18 the Mukilteo Water District for the purpose of certifying the amount of any property 19 tax to be levied and collected therein and causing service and other charges and 20 assessments to be collected from such property owners or occupants thereof, enforcing 21 such collection and performing all other acts necessary to insure performance of the 22 District's contractual obligations in the same manner and by the same means as if the 23 territory of the District had not been included in the boundaries of the City of Everett. 24 Section 5: If property taxes or assessments have been levied and service and 25 other charges have been accrued for such purpose but have not been collected by the 26 District prior to the effective date of this ordinance, the same when collected shall 27 belong and be paid to the City of Everett and used by the City so far as necessary for 28 payment of the indebtedness of the District existing and unpaid on the effective date 29 hereof. Any funds received by the City of Everett which have been collected for the 30 purpose of paying any bonded or other indebtedness of the District shall be used for the 31 purpose for which they were collected and for no other purpose.
