1 indebtedness shall be paid as provided in the bond covenants of the Mukilteo Water <br /> 2 District. All funds of the District on deposit with the County Treasurer at the time of <br /> 3 the effective date of this ordinance shall be used by the City solely for the benefit of <br /> 4 the utility and shall not be transferred to or used for the benefit of the City of <br /> 5 Everett's general fund. <br /> 6 Section 6: Pursuant to RCW 35.13A.030 it is understood that only "that <br /> 7 portion of the entire [Mukilteo Water] district not included within another city" (in <br /> 8 this case the City of Mukilteo) is subject to assumption by the City of Everett. <br /> 9 However, in view of statutory gaps concerning operation immediately after assumption, <br /> 10 and the need to protect and assure bondholders of continued security for their <br /> 11 investment, the Mayor of the City of Everett is hereby authorized to enter into <br /> 12 negotiations with the City of Mukilteo to take whatever steps are necessary in order to <br /> 13 make an appropriate transition, especially for bonding purposes, including, but not <br /> 14 necessarily limited to, drafting a joint operating agreement and/or providing water <br /> 15 service within the City of Mukilteo in the same manner as the District now provides, to <br /> 16 assume operation of the District's property, facilities and equipment within the City of <br /> 17 Mukilteo, and make and enforce such charges for operation, maintenance and payment <br /> 18 of indebtedness as may be reasonable under all the circumstances. The Mayor is further <br /> 19 authorized in such negotiations to provide for assumption by the City of Mukilteo of <br /> 20 District property, facilities, equipment and functions outside the City limits of <br /> 21 Mukilteo so long as such assumption is limited to areas where an assumption would not <br /> 22 be inconsistent with the long-range goals, plans and proposed spheres of influence of <br /> 23 the City of Everett. To this end, the Mayor is authorized to discuss and negotiate <br /> 24 potential future boundaries between the respective municipalities, which potential <br /> 25 future boundary negotiations shall, however, be subject to review and approval by the <br /> 26 City Council of Everett prior to any formal or informal recognition of said negotiations. <br /> 27 Section 7: The City of Everett offers to employ every full-time employee of <br /> 28 the Mukilteo Water District who is engaged in the operation of the District facilities on <br /> 29 the effective date hereof. The Mayor shall make arrangements: 1) for the retention of <br /> 30 service credits under the pension plan of the District pursuant to RCW 41.04.070 to <br /> 31 41.04.110, 2) for the retention of all sick leave standing to the employee's credit in the <br /> 32 -3- <br />
