1 $1,000,000 Bodily Injuryby Disease — each employee <br /> 2 $1,000,000 Bodily Injury by Disease — policy limits <br /> 3 <br /> 4 COE 1-07.18(5)J.RTF <br /> 5 1-07.18(5)J Pollution Liability <br /> 6 (January 4, 2016 APWA GSP) <br /> 7 <br /> 8 The Contractor shall provide a Contractors Pollution Liability policy, providing coverage for <br /> 9 claims involving bodily injury, property damage (including loss of use of tangible property <br /> 10 that has not been physically injured), cleanup costs, remediation, disposal or other handling <br /> 11 of pollutants, including costs and expenses incurred in the investigation, defense, or <br /> 12 settlement of claims, arising out of any one or more of the following: <br /> 13 1. Contractor's operations related to this project. <br /> 14 2. Remediation, abatement, repair, maintenance or other work with lead-based paint or <br /> 15 materials containing asbestos. <br /> 16 3. Transportation of hazardous materials away from any site related to this project. <br /> 17 <br /> 18 All entities listed under 1-07.18(2) of these Special Provisions shall be named by <br /> 19 endorsement as additional insureds on the Contractors Pollution Liability insurance policy. <br /> 20 <br /> 21 Such Pollution Liability policy shall provide the following minimum limits: <br /> 22 *** $2,000,000 *** each loss and annual aggregate ' <br /> 23 <br /> 24 1-07.18(5)K.RTF <br /> 25 1-07.18(5)K Professional Liability I <br /> 26 (January 4, 2016 APWA GSP) <br /> 27 <br /> 28 The Contractor and/or its Subcontractor(s) and/or its design consultant providing <br /> 29 construction management, value engineering, or any other design-related non-construction <br /> 30 professional services shall provide evidence of Professional Liability insurance covering <br /> 31 professional errors and omissions. <br /> 32 <br /> 33 Such policy shall provide the following minimum limits: <br /> 34 $1,000,000 per claim and annual aggregate <br /> 35 <br /> 36 If the scope of such design-related professional services includes work related to pollution <br /> 37 conditions, the Professional Liability insurance shall include coverage for Environmental <br /> 38 Professional Liability. <br /> 39 <br /> 40 If insurance is on a claims made form, its retroactive date, and that of all subsequent <br /> 41 renewals, shall be no later than the effective date of this Contract. <br /> 42 <br /> 43 1-07.23.GR1 <br /> 44 Public Convenience and Safety ' <br /> 45 <br /> 46 1-07.23(1).GR1 <br /> 47 Construction Under Traffic <br /> 48 <br /> 49 1-07.23(1),INSTI.GR1 <br /> 50 Section 1-07.23(1) is supplemented with the following: <br /> 51 <br /> HOT MIX ASPHALT OVERLAY-2018 PAGE 22 OF 57 March 6,2018 <br /> WORK ORDER#3667 <br /> SPECIAL PROVISIONS <br />
