2 <br /> ORDINANCE NO. <br /> An Ordinance Amending the City's Electric Fence Regulations,Amending Section 39 of <br /> Ordinance No. 1671-89, as amended (EMC 19.39.070); Section 3(B) of Chapter 4 of <br /> Ordinance No.2530-01, as amended (EMC 15.16.080.A); and Section 1 of Ord. 4022, as <br /> amended(EMC 16.56.010) <br /> WHEREAS,the City Council finds the following: <br /> 1. The Zoning and Building Codes include regulations for fences, including electric fences, <br /> which prohibit the installation of electric fences, except within the A-1 (Agricultural) <br /> zone; <br /> 2. Electric Guard Dog, a private company requested that the City initiate consideration of a <br /> an amendment to the City's Zoning Code regulations to allow for installation of electric <br /> fences for security purposes for certain commercial or industrial properties; <br /> 3. The Planning Commission agreed to initiate consideration of a code amendment process; <br /> 4. The Planning Commission held a Public Workshop on January 16,2018,to consider <br /> public comments and information from City staff and from the proponent for the code <br /> amendment, and requested additional information from City staff; <br /> 5. The Planning Commission held a Public Hearing on February 20, 2018,to consider the <br /> additional information requested at the January 16, 2018 Public Workshop, additional <br /> public testimony, and a recommendation from City staff for amendments to the Zoning <br /> Code (EMC Title 19),the Building Code(EMC Title 16), and the Project Review <br /> Procedures (EMC Title 15); <br /> 6. The Planning Commission has recommended that the City Council approve amendments <br /> to the Everett Municipal Code pertaining to the regulations for electric fences. <br /> WHEREAS,the Planning Commission concludes the following: <br /> 1. The proposed amendments to the Everett Municipal Code will provide for the public <br /> health, safety and general welfare of the community; <br /> 2. The proposed amendments are not inconsistent with any existing policies of the Everett <br /> Growth Management Comprehensive Plan; <br /> 1 <br /> 4 <br />
