0 <br /> EXFIIBIT D <br /> FORM OF AMENDMENT <br /> AMENDMENT NO.1 <br /> TO <br /> PROFESSIONAL SERVICES AGREEMENT <br /> This Amendment No. 1 is dated for reference purposes 201_. It is by and between the City of <br /> Everett,a municipal corporation under the laws of the State of Washington("City")and Brian Borrello("Artist"). <br /> RECITALS <br /> A. The City and Service Provider are parties to the Professional Services Agreement dated <br /> (the"Agreement"). <br /> B. The City and the Service Provider desire to amend the Agreement for the purpose of adding the <br /> Second Phase of the Work. <br /> AGREEMENT <br /> The City and Artist agree as follows: <br /> 1. The Agreement is modified so that total compensation,including all services and expenses,will not exceed <br /> [insert new total compensation]. <br /> 2. The scope of work under the Agreement is modified to add the Second Phase, so that the scope of work is <br /> amended by adding work in accordance with Approved Design,all as set forth in the attached Exhibit 1. <br /> 3.
