4 <br /> or allow to be maintained on the property outside of a fully enclosed structure such <br /> as a shed, dwelling, or closeable garage, any of the following conditions visible from <br /> any street, alley, or other public or private property: <br /> (A)Junk, trash, litter, boxes, discarded lumber or salvage materials or other similar <br /> materials. <br /> (C) Broken or discarded furniture, household equipment and furnishings; <br /> (E) Dead, decayed, diseased, noxious or hazardous trees or vegetation, or any <br /> vegetation (not including vegetation located in flower beds) taller than forty-two <br /> inches high or grass taller than twelve inches in height; <br /> (F) Graffiti on the exterior of any building, fence or other structure; <br /> Conclusions of Law Based on Above Findings: <br /> 1. The residential structure on the property is neglected and abandoned and is an <br /> attractive nuisance to children because it creates a temptation for children to <br /> explore and play in the buildings or structures to their danger. The residential <br /> structure is a harbor for vagrants and/or criminals. This condition renders the <br /> residential structure as dangerous as defined by IPMC 108.1.5(7) and is in violation <br /> of IPMC 106.1. The Respondents violated said City ordinance. <br /> 2. The residential structure on the property is vacant and the property is not <br /> maintained in a clean, safe and sanitary condition causing blight in the <br /> neighborhood in violation of IPMC 301.2 and IPMC 301.3. The Respondents <br /> violated said City ordinance. <br /> 3. Discarded furniture and miscellaneous items on the property in public view are <br /> violations of EMC 8.20.020(A)(C) and a public nuisance. The Respondents violated <br /> said City ordinance. <br /> 4. Vegetation on the property exceeds the maximum 12 inch height allowed by City <br /> ordinance and is a violation of EMC 8.20.020(E) and a public nuisance. The <br /> Respondents violated said City ordinance. <br /> 5. Graffiti on the exterior walls of the residential structure, in public view on the <br /> property, is a violation of EMC 8.20.020(F) and a public nuisance. The <br /> Respondents violated said City ordinance. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby <br /> determined that the Respondents are in default and were in violation of IPMC 106.1, <br /> IPMC 301.2, IPMC 301.3 and EMC 8.20.020(A)(C)(E)(F) and are hereby ordered to: <br /> 3 <br />
