/ • 1 ` g;. � a ORDINANCE NO. 990 AN ORDINANCE amending Ordinance No. 537-78 which amended Ord. No. 3572 by adding Flood Plain Regulations to the Zoning Code (E. M. C. Chapter 19.11) WHEREAS, on November 9, 1982, the Everett Planning Commission held a public hearing regarding a change to the Flood Fringe Overlay District section of the City of Everett Zoning Code (E. M. C. 19.11.050); and WHEREAS, the City Council of Everett, after hearing the recommendation of the Everett Planning Commission, has determined that said change would be in the best interest of the City of Everett; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That Section 1, Subsection E, Flood Fringe Overlay District, which now reads as follows: Section 1: E. FLOOD FRINGE OVERLAY DISTRICT The requirements of this district are in addition to those contained in the basic underlying use district. 1. Permitted Uses a. Any use permitted in Section D. b. Any use consistent with Everett's Shoreline Master Program. c. Any use permitted in the underlying zone. 2. Development Standards for Permitted Uses. a. The first floor of structures shall be two (2) feet above the regulatory flood protection elevation. b. The fill shall be two (2) feet above the regulatory flood- protection elevation for a distance of fifteen (15) feet beyond any structure in any direction. c. Beyond fifteen (15) feet from any structure the fill shall be no lower than one (1) foot below the regulatory flood-protection elevation. d. Compliance with Federal Regulations Title 24 (CFR) Section 1910.3. 3. Conditional Uses - Flood Fringe The following uses and other similar uses may be permitted at an elevation below the regulatory flood protection elevation, upon compliance with Section G. a. Marinas, boat rentals, boat building and repair. b. Railroads, streets, utility transmission lines, and pipe lines. c. Accessory storage yards for equipment machinery or materials. is hereby amended to read as follows:
