1 ORDINANCE NO. ?f g4/1-15 . <br /> 2 <br /> AN ORDINANCE adopting enforcement regulations for the Public Works <br /> 3 Department. <br /> 4 <br /> 5 WHEREAS, the City Council finds that there exists a need to adopt the following <br /> 6 regulations to provide the Public Works Department with necessary enforcement <br /> 7 powers; <br /> 8 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 9 Section 1: AUTHORITY. The Director of Public Works, or his designee, is <br /> 10 hereby authorized to stop work on all or any part of any unauthorized work on public <br /> 11 property or all or any part of work authorized by any permit issued by the Public Works <br /> 12 Department. The authority to stop work shall be exercised by a written Stop Work <br /> 13 Notice which shall: (a) state the reason(s) for Stop Work including but not limited to, <br /> 14 provisions of applicable ordinances, regulations, policies, plans and/or specifications, or <br /> 15 permit(s); (b) describe work that shall not be performed; and (c) describe defects, if any, <br /> 16 and corrective actions to be taken by permittee. <br /> 17 Section 2: PROCEDURE. Whenever the Director of Public Works or his <br /> 18 designee orders work stopped pursuant to the authority granted in Section 1, the <br /> 19 following procedure shall be followed: <br /> 20 <br /> a. Stop Work Notice shall be served on any person performing such <br /> 21 work and/or any person causing such work to be done; or <br /> 22 b. A Stop Work Notice shall be posted at the site of the work being <br /> done. <br /> 23 <br /> 24 Section 3: VIOLATIONS - STOP WORK ORDER. <br /> 25 A. No person, firm, corporation or association shall perform work in violation <br /> 26 of a Stop Work Notice issued by the Director of Public Works or his designee. <br /> 27 B. No person, firm, corporation or association shall remove, mutilate, <br /> 28 destroy or conceal a Stop Work Notice issued and posted by the Director of Public <br /> 29 Works or his designee. <br /> 30 C. When a Stop Work Notice has been issued, no person, firm, corporation or <br /> 31 association shall fail to take and/or complete any corrective actions designated by the <br /> 32 Director of Public Works or his designee. <br />
