1 Section 4: PENALTIES. Any person, firm, corporation or association <br /> 2 violating Section 3 of this ordinance shall be deemed guilty of a misdemeanor and, upon <br /> 3 conviction thereof, shall be punishable by a fine not to exceed $500 or by imprisonment <br /> 4 in jail not to exceed six months, or both fine and imprisonment. Each separate day or <br /> 5 any portion thereof, during which any violation of this ordinance occurs or continues, <br /> 6 shall be deemed to constitute a separate offense and, upon conviction thereof, shall be <br /> 7 punishable as herein provided. <br /> 8 Section 5: INJUNCTION. The City is authorized to apply to any court of <br /> 9 competent jurisdiction for, and such court upon hearing and for cause shown may grant <br /> 10 a temporary or permanent injunction restraining any person, firm, association and/or <br /> 11 corporation from violating any ordinance, regulation, policy, plan or specifications <br /> 12 and/or permit issued thereunder for which the Public Works Department is responsible <br /> 13 for administering and compelling compliance therewith. <br /> 14 Section 6: CORRECTIVE ACTION BY THE CITY. When a Stop Work Notice <br /> 15 designates corrective action to be taken, the permittee shall immediately perform the <br /> 16 corrective action(s) as directed by the Director of Public Works or his designee. <br /> 17 In the event the permittee fails to take the designated corrective action within <br /> 18 three work days following service of the Stop Work Notice, then the Director or his <br /> 19 designee is authorized to perform such corrective action or have a third party take such <br /> 20 corrective action as is deemed necessary; provided that in the event the Director of the <br /> 21 Public Works Department, or his designee, finds that a dangerous condition exists, the <br /> 22 Director of the Public Works Department, or his designee, is authorized to immediately <br /> 23 perform such corrective action or have a third party take such immediate corrective <br /> 24 action as is deemed necessary to correct the dangerous condition. <br /> 25 All costs of the City for corrective actions and enforcement actions shall be <br /> 26 borne by the permittee or, in the case no permit is obtained when required, said costs <br /> 27 shall be borne by the person, firm, corporation or association responsible for the <br /> 28 unauthorized work. <br /> 29 Section 7: SUSPENSION OR REVOCATION. The Director of Public Works <br /> 30 or his designee is authorized to suspend or revoke any permit issued by the Public Works <br /> 31 Department whenever the permit is issued in error or on the basis of incorrect <br /> 32 <br /> -2- <br />
