1 Section 4: PENALTIES. Any person, firm, corporation or association 2 violating Section 3 of this ordinance shall be deemed guilty of a misdemeanor and, upon 3 conviction thereof, shall be punishable by a fine not to exceed $500 or by imprisonment 4 in jail not to exceed six months, or both fine and imprisonment. Each separate day or 5 any portion thereof, during which any violation of this ordinance occurs or continues, 6 shall be deemed to constitute a separate offense and, upon conviction thereof, shall be 7 punishable as herein provided. 8 Section 5: INJUNCTION. The City is authorized to apply to any court of 9 competent jurisdiction for, and such court upon hearing and for cause shown may grant 10 a temporary or permanent injunction restraining any person, firm, association and/or 11 corporation from violating any ordinance, regulation, policy, plan or specifications 12 and/or permit issued thereunder for which the Public Works Department is responsible 13 for administering and compelling compliance therewith. 14 Section 6: CORRECTIVE ACTION BY THE CITY. When a Stop Work Notice 15 designates corrective action to be taken, the permittee shall immediately perform the 16 corrective action(s) as directed by the Director of Public Works or his designee. 17 In the event the permittee fails to take the designated corrective action within 18 three work days following service of the Stop Work Notice, then the Director or his 19 designee is authorized to perform such corrective action or have a third party take such 20 corrective action as is deemed necessary; provided that in the event the Director of the 21 Public Works Department, or his designee, finds that a dangerous condition exists, the 22 Director of the Public Works Department, or his designee, is authorized to immediately 23 perform such corrective action or have a third party take such immediate corrective 24 action as is deemed necessary to correct the dangerous condition. 25 All costs of the City for corrective actions and enforcement actions shall be 26 borne by the permittee or, in the case no permit is obtained when required, said costs 27 shall be borne by the person, firm, corporation or association responsible for the 28 unauthorized work. 29 Section 7: SUSPENSION OR REVOCATION. The Director of Public Works 30 or his designee is authorized to suspend or revoke any permit issued by the Public Works 31 Department whenever the permit is issued in error or on the basis of incorrect 32 -2-
