WHEREAS, that estimate is accompanied by a diagram of the proposed • improvement showing thereon the lots, tracts, parcels of land and other property which will be specially benefitted by the proposed improvement and the estimated cost and expense thereof to be borne by each lot, tract and parcel of land or other property; and WHEREAS, due notice of the above hearing was given in the manner provided by law, and the hearing was held by the City Council on the date and at the time above-mentioned and thereafter continued on September 22, 1982, at 7:00 p.m., and all written protests filed with the City Council on or before September 15, 1982 date were duly considered and overruled and all persons appearing at the September 15, and September 22, hearing wishing to be heard were heard; and WHEREAS, the City Council has determined it to be in the best interests of the City that the improvement as hereinafter described be carried out and that a local improvement district be created in connection therewith; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: The City Council of the City of Everett, Washington (the "City"), hereby orders the acquisition, construction and installation of street and right-of- way improvements, water system improvements, and Pigeon Creek Regional Storm Detention System improvements described as follows: Campus Parkway, formerly called 77th Way by the construction of a 40- foot wide street; curbs and gutters; sidewalks on the northeast side, and on the southwest side from a point 199.98 feet east of Evergreen Way right-of-way west; a storm drainage system; traffic signal system at Evergreen Way right-of-way west; a storm drainage system; traffic signal system at Evergreen Way; and a street lighting and underground wiring system; a 12-inch water main from Evergreen Way to Casino Road; a Regional Storm Detention System; and necessary appurtenances as determined by the City Engineer in connection therewith. Such improvements shall include the acquisition of property rights-of-way necessary to carry out the above improvements. All of the foregoing shall be in accordance with the plans and specifications therefore prepared by the City Public Works Department, and may be modified by the City Council as long as such modification does not affect the purpose of the improvement. Section 2: There is hereby created and established a local improvement district to be called Local Improvement District No. 711, which the boundary of the district is more particularly described as: 02
