WHEREAS, that estimate is accompanied by a diagram of the proposed • <br /> improvement showing thereon the lots, tracts, parcels of land and other property <br /> which will be specially benefitted by the proposed improvement and the estimated <br /> cost and expense thereof to be borne by each lot, tract and parcel of land or other <br /> property; and <br /> WHEREAS, due notice of the above hearing was given in the manner provided <br /> by law, and the hearing was held by the City Council on the date and at the time <br /> above-mentioned and thereafter continued on September 22, 1982, at 7:00 p.m., and <br /> all written protests filed with the City Council on or before September 15, 1982 <br /> date were duly considered and overruled and all persons appearing at the September <br /> 15, and September 22, hearing wishing to be heard were heard; and <br /> WHEREAS, the City Council has determined it to be in the best interests of <br /> the City that the improvement as hereinafter described be carried out and that a <br /> local improvement district be created in connection therewith; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: The City Council of the City of Everett, Washington (the "City"), <br /> hereby orders the acquisition, construction and installation of street and right-of- <br /> way improvements, water system improvements, and Pigeon Creek Regional Storm <br /> Detention System improvements described as follows: <br /> Campus Parkway, formerly called 77th Way by the construction of a 40- <br /> foot wide street; curbs and gutters; sidewalks on the northeast side, and <br /> on the southwest side from a point 199.98 feet east of Evergreen Way <br /> right-of-way west; a storm drainage system; traffic signal system at <br /> Evergreen Way right-of-way west; a storm drainage system; traffic <br /> signal system at Evergreen Way; and a street lighting and underground <br /> wiring system; a 12-inch water main from Evergreen Way to Casino <br /> Road; a Regional Storm Detention System; and necessary appurtenances <br /> as determined by the City Engineer in connection therewith. <br /> Such improvements shall include the acquisition of property rights-of-way <br /> necessary to carry out the above improvements. <br /> All of the foregoing shall be in accordance with the plans and specifications <br /> therefore prepared by the City Public Works Department, and may be modified by <br /> the City Council as long as such modification does not affect the purpose of the <br /> improvement. <br /> Section 2: There is hereby created and established a local improvement <br /> district to be called Local Improvement District No. 711, which the boundary of the <br /> district is more particularly described as: <br /> 02 <br />
