• <br /> CONCOMITANT AGREEMENT TO REZONE ORDINANCE NO. 883-82 <br /> This Agreement, made and entered into this 23th day of September 1982, by And <br /> I between the City of Everett, a municipal corporation, hereinafter called the City, <br /> II; i and Casino Road Enterprises, hereinafter called the Owner, WITNESSETH: <br /> WHEREAS, such rezoning and development to the new zone standards would - <br /> i1 <br /> l; create a situation where the site could develop under a unified development site <br /> !i <br /> � plan that best serves the general public and protects the public health, safety, and <br /> 1 welfare. <br /> ; WHEREAS, the standards, conditions and requirements mutually agreed upon <br /> • are anticipated to migrate the impacts of this development. <br /> NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br /> 1 1. That detailed drawings shall be submitted to the Public Works <br /> 1 Department showing site parking layout, landscaping, utilities, storm <br /> drainage, temporary construction erosion control and all required <br /> improvements in the public right-of-way. Public Works Department <br /> i' approval of these drawings is required prior to any permits being issued. <br /> All improvements shall be completed, approved and warranted before <br /> the Occupancy Permit is issued. <br /> 2. Participation in the cost to fund the Southend Sewer Interceptor is <br /> 11 required. The approximate cost based on the preliminary information <br /> provided is $.117/sq. ft. for Retail, $.213/sq. ft. for Office, $.0213/sq. <br /> ft. for Warehouse and $.234/sq. ft. for Grocery. The actual cost shall <br /> 11 be computed by the Building Department per the Ordinance in effect at <br /> 1111 the time and according to the information provided on the approved <br /> plans on the date of permit issuance. <br /> it <br /> 1 3. Detention is required; all detention shall be approved by the Everett <br /> i Public Works Department. On-site detention may be met by a <br /> contribution to a regional detention system. <br /> 4. During construction, all truck traffic to and from the site within the <br /> City of Everett shall be on arterial streets unless otherwise approved by <br /> the Public Works Department. <br /> 5. City streets and alleys are to be kept clear of dirt and debris at all <br /> 11 times during construction. Dust suppression and street cleaning must <br /> 11 occur as directed by the Public Works Inspector. <br /> 1 6. All exposed ground must be reseeded within 30 days of the completion <br /> of construction. If building activity commences within 30 days of the <br /> 11 <br /> completion of construction, reseeding will not be required. If reseeding <br /> is not practical due to weather or seasonal problems, the ground must <br /> be covered with mulch as directed by the City Engineer. <br /> I� 7. As-builts of storm sewer system can be submitted as prints and must be <br /> I submitted before the Occupancy Permit is issued. <br /> 1 <br /> 1 8. A one year Warrantee Guarantee is required on the public landscaping <br /> for an amount not less than 10% of the cost of construction and shall <br /> run for one year from the date of final approval/issuance of the first <br /> Occupancy Permit for the project. <br /> 1 9.
