• <br /> 1 ORDINANCE NO. 3Z, 2">" <br /> 2 <br /> AN ORDINANCE providing for the abatement and removal as public <br /> 3 nuisances of certain wrecked, dismantled or inoperative vehicles or <br /> automobile hulks or parts thereof from private property; providing <br /> 4 for the abatement and removal of abandoned vehicles, abandoned <br /> vehicle hulks and abandoned junk motor vehicles in the manner <br /> 5 prescribed by the Washington Model Traffic Ordinance; and pre- <br /> scribing penalties for violations. <br /> 6 <br /> 7 <br /> 8 WHEREAS, the City of Everett has adopted the Washington Model Traffic <br /> 9 Ordinance; and <br /> 10 WHEREAS, 1980 amendments to the Washington Model Traffic Ordinance <br /> 11 contained in Section 2 of House Bill 1593, Chapter 65, Laws of 1980, an amendment to <br /> 12 RCW 46.90.300, had the effect of adopting Revised Code of Washington Sections <br /> 13 46.52.104 through 46.52.1198 and 46.52.160 through 46.52.210 which specify various <br /> 14 procedures to be followed if a city implements its authority to remove certain vehicles <br /> 15 and vehicle hulks from public or private property; and <br /> 16 WHEREAS, RCW 46.61.565 and City of Everett ordinance provisions specify <br /> 17 certain circumstances under which vehicles may be removed from public property; and <br /> 18 WHEREAS, RCW 46.52.117 provides that a city may adopt an ordinance <br /> 19 establishing procedures for the abatement and removal as public nuisances of <br /> 20 abandoned, wrecked, dismantled or inoperative vehicles or automobile hulks or parts <br /> 21 thereof from private property so long as its ordinance contains certain mandatory <br /> 22 provisions; and <br /> 23 WHEREAS, RCW 46.52.116 provides that a city may adopt an ordinance <br /> 24 establishing procedures for the disposition of abandoned vehicles so long as they are <br /> 25 processed in the manner provided in RCW 46.52.111 and 46.52.112; and <br /> 26 WHEREAS, the City Council deems it to be in furtherance of the public health, <br /> 27 safety and general welfare to adopt an ordinance providing for the abatement and <br /> 28 removal as public nuisances of wrecked, dismantled or inoperative vehicles or auto- <br /> 29 mobile hulks or parts thereof from private property and providing for the abatement <br /> 30 and removal of abandoned vehicles, abandoned vehicle hulks and abandoned junk motor <br /> 31 vehicles in the manner provided by pertinent provisions of the Washington Model Traffic <br /> 32 Ordinance, RCW 46.90; <br />
