• <br /> 1 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 2 Section 1: DEFINITIONS. For the purposes of this chapter, the following <br /> 3 words shall have the following meanings: <br /> 4 A. "Abandoned vehicle" means any vehicle or automobile hulk left within the <br /> 5 right-of-way of any highway or on the property of another without consent of the <br /> 6 owner of such property for a period of twenty-four hours or longer; provided, that a <br /> 7 vehicle or hulk shall not be considered abandoned if it is lawfully parked for a period <br /> 8 not exceeding seventy-two hours; provided further, that a vehicle or hulk shall not be <br /> 9 considered abandoned if its owner or operator is unable to remove it from the place <br /> 10 where it is located and so notifies law enforcement officials and requests assistance. <br /> 11 B. "Abandoned junk motor vehicle" means any motor vehicle substantially <br /> 12 meeting the following requirements: (RCW 46.52.145(1)) <br /> 13 1. Left on private property for more than 24 hours without the <br /> permission of the person having right to the possession of the <br /> 14 property, or on a public street or other property open to the public <br /> for purposes of vehicular travel or parking, or upon or within the <br /> 15 right-of-way of any road or highway for twenty-four hours or <br /> longer; <br /> 16 <br /> 2. Three years old, or older; <br /> 17 <br /> 3. Extensively damaged, such damage including but not limited to any <br /> 18 of the following: a broken window or windshield, missing wheels, <br /> tires, motor or transmission; <br /> 19 <br /> 4. Apparently inoperable; <br /> 20 <br /> 5. Without a valid, current registration plate; <br /> 21 <br /> 6. Having a fair market value equivalent to the scrap therein, only. <br /> 22 <br /> 23 C. "Automobile hulk" means any portion or portions of a motor vehicle which <br /> 24 is inoperative and cannot be made mechnically operative without additional vital parts <br /> 25 and a substantial amount of labor. <br /> 26 D. In addition to the definition of "motor vehicle" and "vehicle" as set forth <br /> 27 in RCW 46.04.320 and RCW 46.04.670, the term "vehicle," for purposes of this <br /> 28 ordinance, shall include abandoned vehicles, abandoned junk motor vehicles and <br /> 29 automobile hulks. <br /> 30 E. "Department" shall mean the Washington State Department of Licensing. <br /> 31 F. "Director" shall mean the Director of the Department of Licensing or his <br /> 32 designee. <br /> -2- <br />
