• <br /> 1 ORDINANCE NO. 8:576-- <br /> 2 S-2 <br /> 3 AN ORDINANCE establishing the ownership, maintenance and operation <br /> of side sewers within the public right-of-way, and clarifying the <br /> 4 responsibilities of private property owners regarding side sewer <br /> ownership and maintenance, and amending Ordinance No. 296-74 <br /> 5 (EMC 14.08.260). <br /> 6 <br /> 7 THE CITY OF EVERETT DOES ORDAIN: <br /> 8 Section 1: Section 1 of Ordinance No. 296-74 (EMC 14.08.260) which reads as <br /> 9 follows: <br /> 10 <br /> "Side Sewer Ownership and Maintenance <br /> 11 <br /> (a) The City of Everett Sewer Department shall subsequent to approved <br /> 12 installation, own, maintain and operate side sewer connections within the <br /> boundaries of the public right-of-way. The City of Everett Sewer <br /> 13 Department shall not be responsible for maintenance and operation of side <br /> sewers outside the public right-of-way. <br /> 14 <br /> (b) In the event a side sewer becomes blocked or stopped, it shall be the <br /> 15 responsibility of the customer whose premises are attached to the side <br /> sewer at his expense to investigate, by a roto-rooter type equipment or <br /> 16 other approved method, whether the blockage or stoppage is on his <br /> premises or within the public right-of-way. In the event that the <br /> 17 customer has cause to believe the stoppage is within the public <br /> right-of-way, he shall notify the City Sewer Department which shall <br /> 18 investigate and determine the location. The determination of the <br /> Director of Utilities and Engineering, or his designee, shall be final and <br /> 19 conclusive. If it is determined that the stoppage is within the responsi- <br /> bility of the City, the bill for services of the contractor shall be paid or <br /> 20 reimbursed by the City Sewer Fund for all work related to investigation <br /> and work on public right-of-way and the City Sewer Department shall be <br /> 21 repsonsible for the repair of the side sewer within the public <br /> right-of-way, as herein provided, at no cost to the customer. Payment of <br /> 22 said bill or said reimbursement in accordance with the aforesaid <br /> procedure shall be pursuant to the duty etablished by this ordinance and a <br /> 23 damage claim may be waived. <br /> 24 (c) Side sewers shall not be installed nogextended in streets or alleys by <br /> customers unless specifically approved by the Sewer Department prior to <br /> 25 such installation and a permit is obtained by the customer from the City <br /> Engineer's Office. <br /> 26 <br /> (d) Side sewer connections to the sewer main will be made at the owner's <br /> 27 expense, under the inspection or supervision of the Sewer Department." <br /> 28 <br /> is hereby amended to read hereafter as follows: <br /> 29 <br /> 30 "Side Sewer Ownership and Maintenance <br /> 31 (a) The City of Everett Sewer Department shall subsequent to approved <br /> installation, own, maintain and operate side sewer connections within the <br /> 32 <br />
