A <br /> ji • <br /> Concomitant Agreement to Rezone Ordinance No. g 3 3-SZ <br /> This Agreement, made and entered into this sixth day of January, 1982, by and <br /> between the City of Everett, a municipal corporation, hereinafter called the City, and <br /> Daniel A. Lagozzino, Jean Lagozzino, James A. Klicpera and Barbara Klicpera. <br /> WHEREAS the owner has made application to the City for a change in the zoning <br /> classification of the following described parcel: <br /> Lots 7, 8, 9 and 10, Block 786, Plat of Everett, Div. H <br /> Situate in the County of Snohomish, State of Washington. <br /> WHEREAS, such rezoning and development to the new zone standards would <br /> create a situation where clinic with parking lot use would abut a residential zone; and <br /> the public health, safety and welfare would be best served by anticipating the impact <br /> of such development and imposing certain mutually agreed upon standards, conditions <br /> and requirements; <br /> NOW, THEREFORE, IT IS MUTUALLY AGREED AS'FOLLOWS: <br /> 1. The site shall be developed as a medical clinic or the existing clinic on lots 1-5 <br /> may be expanded with the appropriate amount of parking as required by City <br /> Code. Parking lot development is not permitted unless related to a specific clinic <br /> use. <br /> 2. A detailed landscaping plan will be prepared by the Applicant and approved by <br /> the Planning Department with specific attention given to creating an effective <br /> screen along the south property line. <br /> 3. Detailed building design and final site plan shall be approved by the Planning <br /> Department prior to issuance of any permit. <br /> 4. Detailed drawings shall be submitted to the Public Works Department showing <br /> parking layout, landscaping, storm drainage, temporary construction erosion <br /> control and all required improvements in the public right-of-way. Public Works <br /> Department approval of these drawings is required prior to any permits being <br /> issued. <br /> 5. City streets and alleys are to be kept clear of dirt and debris at all times during <br /> construction. Dust suppression and street cleaning must occur as directed by the <br /> Public Works Inspector. <br /> 6. A one-year Warrantee Bond as required on the public improvements shall be for <br /> an amount not less than 10% of the cost of construction of the sanitary and <br /> storm sewer system and shall run for one year from the date of issuance of the <br /> first Occupancy Permit for the project. <br /> 7. All exposed ground must be reseeded within 30 days of the completion of <br /> construction. If reseeding is not practical due to weather or seasonal problems, <br /> the ground must be covered with mulch as directed by the City Engineer. <br /> -e- <br /> - 1 <br />
