During construction, all truck traffic to and from the site within the City of <br /> Everett shall be on arterial streets unless otherwise approved by the Public <br /> Works Department. <br /> 9. Access will be limited to one curb cut on Nassau. <br /> 10. a. Water System: - Six inch water service to this area is at minimum service <br /> level. Development of the area will be dependent on water demands of the <br /> existing and proposed facilities. New mains may be required dependent on <br /> use of site and fire protection needs. <br /> b. Sanitary Sewer System: - This site is not served by a sewer. A main will <br /> have to be extended to the site, connections may be made to the existing <br /> system on 33rd St. <br /> c. Storm Sewer System: - On site storm water detention will be required in <br /> accordance with Ordinance 514-78 and shall be independently tied to the <br /> public system or, as an alternate, the owner may construct a simple trans- <br /> mission system deleting the detention features. A cash payment of the <br /> cost savings will be made to the City of Everett, Regional Detention Fund <br /> #340 which will be used to fund construction of said facilities within the <br /> rightof-way. In this case, the City wishes you to take the alternate plan. <br /> Provide the City with cash payment rather than having on-site detention. <br /> The payment will be accompanied by estimates of the two systems and the <br /> corrected drainage calculations. <br /> 11. Legal Requirements <br /> The Owners and their successors and assigns shall comply with all city, state and <br /> federal laws, rules and regulations applicable to the development, sale and <br /> maintenance of the subject property. <br /> 12. Recording <br /> This agreement shall be filed in the records of the Snohomish County Auditor for <br /> the purpose of subjecting the subject property to the restrictions, conditions and <br /> limitations herein set forth which are intended and shall have the force and <br /> effect of deed restrictions and shall be deemed to be covenants running with the <br /> land and binding upon the Owners, their successors and assigns. <br /> 13. Enforcement <br /> Any violation of this agreement by the Owners or their successors or assigns shall <br /> be considered a violation of the zoning ordinance of the City of Everett and shall <br /> be subject to all applicable penalties.
