Care will be taken to prevent any petroleum products, chemicals,or other toxic or deleterious materials <br /> from entering the water. if a spill were to occur work shall be stopped immediately, steps taken to <br /> contain the material, and appropriate agency notification shall occur.Fuel hoses, oil drums or fuel <br /> transfer valves and fittings,etc., shall be checked regularly for drips or leaks,and shall be maintained and <br /> stored to prevent spills. <br /> c. Excess or waste material shall not be disposed of or abandoned water ward of the OHWM or MHHW <br /> lines, or allowed to enter waters of the state. <br /> d. The Contractor shall have a spill containment kit,including oil absorbent materials, on the site to be used <br /> in the event of a spill or if any oil product is observed in the water. <br /> e. The Contractor will be required to capture any debris associated with project construction and not allow <br /> it to enter Puget Sound. <br /> f. A debris boom will be installed around the active construction area during construction work. <br /> g. Excavation, armor rock removal,rock placement and pile driving work will only be conducted when the <br /> work area is not inundated with tidal waters. <br /> h. Discrete elements of work will be sequenced to occur during one tidal cycle in order to limit soil <br /> exposure during tidal inundation <br /> i. Land based equipment operation will be contained within the project limits in order to keep equipment <br /> off of non-armored substrate not slated for rock replacement. <br /> j. If required by the regulatory agencies,the Port of Everett and the Contractor shall observe turbidity <br /> during excavation and rock work operations in order to ensure compliance with Water Quality <br /> Certification (WQC)requirements. <br /> k. Appropriate BMP's will be employed to minimize sediment loss and turbidity generation during <br /> excavation and rock work operations in order to ensure compliance with WQC requirements. <br /> 1. Sealant will be installed and allowed to cure during a period of low tide. Only sealant intended for use in <br /> the marine environment will be used. <br /> m. Land based equipment will be staged at a location far enough from bulkhead walls as to not approach <br /> bearing capacity of the bulkhead or rock revetment. <br /> 3. The Port of Everett's Environmental BMPs shall apply to the proposal's construction and subsequent terminal <br /> operations. <br /> 4. All trucks entering the terminal facilities will be required to use designated arterials assigned by the City of <br /> Everett and avoid the use of any local streets. <br /> Note: Issuance of this threshold determination does not constitute approval of local,state and federal permits. <br /> This MDS is issued under WAC 197-11-340(2) and WAC 197-11-350. The lead agency will not act on this I . <br /> proposal for 14 days from the published date below.
