Findings: The Union Slough tidal habitat restoration site is located in EMU 2. <br /> Section 5--Use Regulations <br /> 5.7 Industry <br /> 1. The Shoreline rules clearly provide for a priority of shoreline uses with the highest priority <br /> given to environmental restoration and water dependent and water related uses (see WAC <br /> 173,26.200(2)(d)Preferred uses, 173.26,240(3)(f) Shoreline Use Standards—Industry, and <br /> 173.26.250(3)(c) Shorelines of state-wide significance—priority uses). <br /> Findings: The site is used as a water dependent port terminal. <br /> 6. In all new and expanded port and/or industrial developments,the best available management <br /> practices and procedures shall be employed for safe handling of fuels and toxic or hazardous <br /> materials. <br /> 7. Ports and industry shall employ best management practices(BMPs) concerning the various <br /> services and activities they perform and their impacts on the surrounding water quality. <br /> Operators shall take all actions necessary to insure that contaminants do not enter the water or <br /> storm drainage system. Development and operations shall comply with the City's Drainage <br /> Ordinance and Stormwater Management Manual. <br /> Findings: The Port has enumerated BMPs for this project in the Mitigated Determination of <br /> Non-Significance. Washington Fish and Wildlife has attached several practices to be observed <br /> to protect natural resources. <br /> 6.1 General Shoreline Modification <br /> 1. All shoreline modification activities shall be in support of an existing or permitted/approved <br /> shoreline use, or habitat restoration and enhancement activities. <br /> Findings: The proposed maintenance and enhancement of the existing revetment and bulkhead <br /> is to provide protection for the existing port terminal,which is a permitted shoreline use. <br /> 2. The City shall require sufficient analysis by professionals with appropriate expertise to <br /> document the impacts of shoreline modification proposals. Such analysis may include,but not <br /> be limited to, geotechnical,hydrological, and biological studies,and shall include an analysis <br /> of drift cells when appropriate. Mitigation sequencing shall be required. The City shall require <br /> the use of best available science and best management practices for the design, development, <br /> and ongoing management and monitoring of shoreline modification activities. <br /> Findings: A biological evaluation has been prepared by I lartCrowser to evaluate potential <br /> impacts to threatened and listed species. The design of construction plans will need to meet <br /> City of Everett standards. <br />
