• ORDINANCE NO. 8Ro- 8/ <br /> • AN ORDINANCE repealing Ordinance Nos. 423-76 and 223-73 to allow <br /> for consolidation of prior ordinances, to create consistency with <br /> state regulations, and to allow for outdoor fires under limited <br /> circumstances for the clearing of land. <br /> 1 <br /> 2 WHEREAS, Ordinance No. 423-76 and Ordinance No. 223-73 were adopted to <br /> 3 control outdoor burning in the City of Everett; and <br /> 4 WHEREAS, the above-referenced ordinances contain inconsistencies and do not <br /> 5 follow the most recent regulations adopted by the Puget Sound Air Pollution Control <br /> 6 Agency: and <br /> 7 WHEREAS, it has been the policy of the City of Everett to prohibit outdoor <br /> 8 burning; and <br /> 9 WHEREAS, the prohibition of outdoor burning creates hardship on developers and <br /> 10 commercial entities under certain circumstances, who desire to clear land. <br /> 11 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 12 Section 1: That Ordinance No. 423-76 and Ordinance No. 223-73 are hereby <br /> 13 repealed in their entirety. <br /> 14 Section 2: OUTDOOR BURNING RESTRICTED. <br /> 15 Subject to the exemptions set forth herein, it shall be unlawful for any person to <br /> 16 cause or allow any outdoor fire within the City of Everett and any such outdoor fire is <br /> 17 hereby declared a public nuisance. <br /> 18 Section 3: DEFINITION OF OUTDOOR FIRE. <br /> 19 "Outdoor fire" means the combustion of material in the open. <br /> 20 Section 4: EXEMPTIONS. <br /> 21 The following outdoor fires are exempt from Section 2: <br /> 22 A. Small outdoor fires for pleasure, religious, ceremonial, cooking, or like <br /> 23 social purposes, which are contained in portable or built-in barbecues, fireplaces, <br /> 24 firepits, rotisseries or similar devices not intended for the burning of refuse or debris. <br /> 25 B. Small outdoor fires on salt water beaches not to exceed 4 feet in diameter <br /> 26 and 3 feet high; provided that said fires shall not be located in areas where substantial <br /> 27 driftwood accumulations exist. Provided further, that all beach fires must be <br /> 28 extinguished before leaving the scene of the fire. <br /> 29 C. Fires from torches, incense burners, insect pots, flares and smokeless <br /> 30 waste gas burners. <br /> 31 <br /> 32 <br />
