♦ 0 <br /> • <br /> 1 I. The Everett Fire Chief or his designee has determined that the person <br /> 2 who proposes to burn is in compliance with all applicable City of Everett rules, <br /> 3 regulations, and ordinances. <br /> 4 Section 6: REVOCATION OF RIGHT TO BURN. <br /> 5 In addition to any powers vested in the Control Officer of the Puget Sound Air <br /> 6 Pollution Control Agency, the Everett Fire Chief or his designee may revoke the right <br /> 7 to burn, upon inspection, where a violation of this ordinance is found or because of any <br /> 8 false statement or misrepresentation as to a material fact in the information or plans <br /> 9 submitted on which the right to burn was based. <br /> 10 Section 7: APPEALS. <br /> 11 Whenever the Everett Fire Chief or his designee shall refuse the right to burn or <br /> 12 when it is claimed that the provisions of the code do not apply or that the true intent <br /> 13 and meaning of the code has been misconstrued or wrongly interpreted, the applicant <br /> 14 may appeal the decision of the Fire Chief or his designee to the City Council. Said <br /> 15 appeal must be filed in writing with the City Clerk within 10 working days of the date <br /> 16 that the right to burn has been denied. <br /> 17 Section 8: PENALTIES. <br /> 18 A. Any person who shall violate of the provisions of this ordinance or fail to <br /> 19 comply therewith, or who shall violate or fail to comply with any order made <br /> 20 thereunder, or who shall fail to comply with such an order as affirmed or modified by <br /> 21 the City Council or by a court of competent jurisdiction, shall severally for each and <br /> 22 every such violation and non-compliance respectively, be guilty of a misdemeanor, <br /> 23 punishable by a fine of not more than $500 and/or 6 months in jail. The imposition of <br /> 24 one penalty for any violation shall not excuse the violation or permit it to continue; and <br /> 25 all such persons shall be required to correct or remedy such violations or defects within <br /> 26 a reasonable time; and when not otherwise specified, each day that prohibited <br /> 27 conditions are maintained shall constitute a separate offense. <br /> 28 B. The application of the above penalty shall not be held to prevent the <br /> 29 enforced removal or abatement of prohibited conditions. <br /> 30 <br /> 31 <br /> 32 <br />
