1 ORDINANCE NO. ,5r/ - <br /> 2 <br /> AN ORDINANCE amending Ordinance No. 692-80 (the Land Use Hearing <br /> 3 Examiner Ordinance). <br /> 4 <br /> 5 <br /> WHEREAS, Ordinance No. 692-80, better known as the Land Use Hearing <br /> 6 <br /> Examiner Ordinance, has been in effect for approximately one year; and <br /> 7 <br /> WHEREAS, Ordinance No. 692-80 contains certain language inconsistent with <br /> 8 <br /> other City of Everett policies, ordinances and procedures; <br /> 9 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 10 <br /> Section 1: That Section 12 of Ordinance No. 692-80, which reads as follows: <br /> 11 <br /> 12 Section 12: DUTIES OF THE EXAMINER. <br /> 13 A. Development Actions. <br /> 14 The Examiner shall receive and examine available information <br /> including environmental checklists and impact statements, conduct <br /> 15 public hearings, prepare a record thereof, enter findings of fact <br /> and conclusions based upon those facts, and enter decisions as <br /> 16 provided herein. <br /> 17 1. Decisions. The decisions of the Examiner shall represent <br /> the final action on the application, unless appealed, as <br /> 18 hereinbelow specified, for the following types of develop- <br /> ment action: <br /> 19 <br /> a. Temporary use permit. <br /> 20 <br /> b. Appeals of decisions made by the Responsible <br /> 21 Official under the provisions of the City's <br /> Environmental Policy Ordinance No. 582-79. <br /> 22 <br /> c. Waivers, exceptions and appeals from administrative <br /> 23 determinations of the City's Streets and Sidewalk <br /> Codes. <br /> 24 <br /> d. Appeals from administrative determination of the <br /> 25 City's land use regulation codes. <br /> 26 e. Deferred improvements. <br /> 27 f. Applications for any other land use regulatory <br /> permits which may be required by ordinance, but <br /> 28 excluding variances and conditional use permits <br /> except as specified in Section 12.B.2 and Section 14 <br /> 29 of this ordinance. <br /> 30 g. Short subdivisions as specified by the short sub- <br /> division ordinance. <br /> 31 <br /> h. Nonconforming use expansion permits. <br /> 32 <br />
