The decision of the Examiner on the <br /> following matters shall constitute a recommendation to the <br /> 2 City Council which shall have the final authority to act on <br /> 3 such applications: <br /> a. Rezones, except rezone requests exceeding 3 acres in <br /> 4 size and area-wide rezonings recommended to the <br /> City Council by the Planning Commission. <br /> 5 <br /> b. Preliminary and Final plats as prescribed by the State <br /> 6 and City subdivision laws, except for those pre- <br /> liminary and final plats exceeding 75 lots in size. <br /> 7 <br /> c. Shoreline management substantial development <br /> 8 permits except for permits requested for projects <br /> exceeding five acres in size. <br /> 9 <br /> d. Planned residential developments except for proposed <br /> 10 developments exceeding 50 residential units in size. <br /> 11 e. Special property use permits. <br /> 12 f. Conditional use permits. <br /> 13 3. Jurisdiction Retained by Planning Commission. Under the <br /> provisions of City Ordinance 3-68 and RCW 35.63, the <br /> 14 Planning Commission shall retain jurisdiction for all applica- <br /> tions for development not assigned to the Hearing Examiner <br /> 15 by this ordinance. <br /> 16 B. Recommendation or Decision, Conditions. <br /> 17 1. The Examiner's recommendation or decision may be to grant <br /> or deny the application, or the Examiner may recommend or <br /> 18 require of the applicant such conditions, modifications and <br /> restrictions as the Examiner finds necessary to make the <br /> 19 application compatible with its environment and carry out <br /> the objectives and goals of the Comprehensive Plan, <br /> 20 Shoreline Management Master Program, Housing Assistance <br /> Plan, other applicable plans and programs adopted by the <br /> 21 City Council, the Zoning Ordinance, the Subdivision <br /> Ordinance, and other codes and ordinances of the City of <br /> 22 Everett. Conditions, modifications and restrictions which <br /> may be imposed are, but are not limited to: <br /> 23 <br /> a. Exact location and nature of development, including <br /> 24 additional building and parking area setbacks, screen- <br /> ings in the form of landscaped berms, landscaping or <br /> 25 fencing. • <br /> 26 b. Measures to mitigate the adverse environmental <br /> impacts of the development. <br /> 27 <br /> c. Hours of use or operation or type and intensity of <br /> 28 activities. <br /> 29 d. Sequence and scheduling of development. <br /> 30 e. Maintenance of the development. <br /> 31 f. Duration of use and subsequent removal of <br /> structures. <br /> 32 <br /> -2- <br />
