• <br /> 1 i. Compliance with conditions imposed pursuant to any <br /> land use permit or decision which has been issued by <br /> 2 the City of Everett Land Use Hearing Examiner. <br /> 3 2. Recommendations. The decision of the Examiner on the <br /> following matters shall constitute a recommendation to the <br /> 4 City Council which shall have the final authority to act on <br /> such applications: <br /> 5 <br /> a. Rezones, except rezone requests exceeding 3 acres <br /> 6 in size and area-wide rezonings recommended to the <br /> City Council by the Planning Commission. <br /> 7 <br /> b. Preliminary and Final plats as prescribed by the State <br /> 8 and City subdivision laws, except for those <br /> preliminary and final plats exceeding 75 lots in size. <br /> 9 <br /> c. Shoreline management substantial development <br /> 10 permits except for permits requested for projects <br /> exceeding five acres in size. <br /> 11 <br /> d. Planned residential developments except for proposed <br /> 12 developments exceeding 50 residential units in size. <br /> 13 e. Special property use permits. <br /> 14 f. Conditional use permits. <br /> 15 g. In situations where a planned residential development <br /> is combined with a preliminary and final plat <br /> 16 procedure, the Hearing Examiner shall have juris- <br /> diction over the entire procedure if the preliminary <br /> 17 and final plat is 50 lots or less, or if the planned <br /> residential development is 50 units or less. <br /> 18 <br /> 3. Jurisdiction Retained by Planning Commission. Under the <br /> 19 provisions of City Ordinance 3-68 and RCW 35.63, the <br /> Planning Commission shall retain jurisdiction for all applica- <br /> 20 tions for development not assigned to the Hearing Examiner <br /> by this ordinance. <br /> 21 <br /> B. Recommendation or Decision, Conditions. <br /> 22 <br /> 1. The Examiner's recommendation or decision may be to grant <br /> 23 or deny the application, or the Examiner may recommend or <br /> require of the applicant such conditions, modifications and <br /> 24 restrictions as the Examiner finds necessary to make the <br /> application compatible with its environment and carry out <br /> 25 the objectives and goals of the Comprehensive Plan, <br /> Shoreline Management Master Program, Housing Assistance <br /> 26 Plan, other applicable plans and programs adopted by the <br /> City Council, the Zoning Ordinance, the Subdivision <br /> 27 Ordinance, and other codes and ordinances of the City of <br /> Everett. Conditions, modifications and restrictions which <br /> 28 may be imposed are, but are not limited to: <br /> 29 a. Exact location and nature of development, including <br /> additional building and parking area setbacks, screen- <br /> 30 ings in the form of landscaped berms, landscaping or <br /> fencing. <br /> 31 <br /> 32 -4- <br />
