• 1 i. Compliance with conditions imposed pursuant to any land use permit or decision which has been issued by 2 the City of Everett Land Use Hearing Examiner. 3 2. Recommendations. The decision of the Examiner on the following matters shall constitute a recommendation to the 4 City Council which shall have the final authority to act on such applications: 5 a. Rezones, except rezone requests exceeding 3 acres 6 in size and area-wide rezonings recommended to the City Council by the Planning Commission. 7 b. Preliminary and Final plats as prescribed by the State 8 and City subdivision laws, except for those preliminary and final plats exceeding 75 lots in size. 9 c. Shoreline management substantial development 10 permits except for permits requested for projects exceeding five acres in size. 11 d. Planned residential developments except for proposed 12 developments exceeding 50 residential units in size. 13 e. Special property use permits. 14 f. Conditional use permits. 15 g. In situations where a planned residential development is combined with a preliminary and final plat 16 procedure, the Hearing Examiner shall have juris- diction over the entire procedure if the preliminary 17 and final plat is 50 lots or less, or if the planned residential development is 50 units or less. 18 3. Jurisdiction Retained by Planning Commission. Under the 19 provisions of City Ordinance 3-68 and RCW 35.63, the Planning Commission shall retain jurisdiction for all applica- 20 tions for development not assigned to the Hearing Examiner by this ordinance. 21 B. Recommendation or Decision, Conditions. 22 1. The Examiner's recommendation or decision may be to grant 23 or deny the application, or the Examiner may recommend or require of the applicant such conditions, modifications and 24 restrictions as the Examiner finds necessary to make the application compatible with its environment and carry out 25 the objectives and goals of the Comprehensive Plan, Shoreline Management Master Program, Housing Assistance 26 Plan, other applicable plans and programs adopted by the City Council, the Zoning Ordinance, the Subdivision 27 Ordinance, and other codes and ordinances of the City of Everett. Conditions, modifications and restrictions which 28 may be imposed are, but are not limited to: 29 a. Exact location and nature of development, including additional building and parking area setbacks, screen- 30 ings in the form of landscaped berms, landscaping or fencing. 31 32 -4-
