Granting of easements and dedications for roads, <br /> walkways, utilities or other purposes and dedication <br /> 2 of land or other provisions for public facilities, the <br /> need for which the Examiner finds would be <br /> 3 generated in whole or in significant part by the <br /> proposed development. <br /> 4 <br /> h. Provisions which would bring the proposal into <br /> 5 compliance with the Comprehensive Plan. <br /> 6 i. Posting of performance bonds as required to insure <br /> compliance with any conditions, modifications and/or <br /> 7 restrictions imposed on the proposal. <br /> 8 2. For the purposes of this section, the Examiner shall have all <br /> the powers of the Board of Adjustment. <br /> 9 <br /> 10 is hereby amended to read as follows: <br /> 11 <br /> Section 12: DUTIES OF THE EXAMINER: <br /> 12 <br /> A. Development Actions. <br /> 13 <br /> The Examiner shall receive and examine available information <br /> 14 including environmental checklists and impact statements, conduct <br /> public hearings, prepare a record thereof, enter findings of fact <br /> 15 and conclusions based upon those facts, and enter decisions as <br /> provided herein. <br /> 16 <br /> 1. Decisions. The decisions of the Examiner shall represent <br /> 17 the final action on the application, unless appealed, as <br /> hereinbelow specified, for the following types of develop- <br /> 18 ment action: <br /> 19 a. Temporary use permit. <br /> 20 b. Appeals of decisions made by the Responsible <br /> Official under the provisions of the City's <br /> 21 Environmental Policy Ordinance No. 582-79. <br /> 22 c. Waivers, exceptions and appeals from administrative <br /> determinations of the City's Streets and Sidewalk <br /> 23 Codes. <br /> 24 d. Appeals from administrative determination of the <br /> City's land use regulation codes. <br /> 25 <br /> e. Deferred improvements. <br /> 26 <br /> f. Applications for any other land use regulatory <br /> 27 permits which may be required by ordinance, but <br /> excluding variances and conditional use permits <br /> 28 except as specified in Section 12.B.2 and Section 14 <br /> of this ordinance. <br /> 29 <br /> g. Short subdivisions as specified by the short sub- <br /> 30 division ordinance. <br /> 31 h. Nonconforming use expansion permits. <br /> 32 <br /> -3- <br />
