• <br /> • <br /> 1 ORDINANCE NO. 8/7-e/ <br /> 2 <br /> AN ORDINANCE amending Ordinance 368-75, Section 1, and Ordinance <br /> 3 4157, Section 3 - Subdivision Ordinance - Definitions, (EMC <br /> 18.04.030); and adding a new section. <br /> 4 <br /> 5 <br /> WHEREAS, City Council desires to make changes in the definitions which are set <br /> 6 <br /> forth in the Subdivision Ordinance; and <br /> 7 <br /> WHEREAS, Planning Commission recommends that City Council adopt the <br /> 8 <br /> following changes to the Subdivision Ordinance; and <br /> 9 <br /> WHEREAS, City Council finds that the Subdivision Ordinance is enacted as <br /> 10 <br /> protection for the general public and not to create a duty to or in favor of persons <br /> 11 <br /> individually. <br /> 12 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 13 <br /> Section 1: Ordinance 368-75, Section 1, and Ordinance 4157, Section 3 which <br /> 14 <br /> read as follows: <br /> 15 <br /> 16 DEFINITIONS: <br /> 17 A. "City council" means the city council, the legislative body, of the <br /> city. <br /> 18 <br /> 13. "Comprehensive plan" or portions thereof are those coordinated <br /> 19 plans in preparation or which have been prepared by the city <br /> planning commission for the physical development of the munici- <br /> 20 pality, which designate, among other things, plans and programs to <br /> encourage the most appropriate use of land, and lessen congestion <br /> 21 throughout the municipality, in the interest of public health, safety <br /> and welfare. <br /> 22 <br /> C. "Dedication" is the deliberate appropriation of land by its owner <br /> 23 for any general and public use. <br /> 24 D. "Final approval" is the final official action taken by the city <br /> council on a proposed plat, subdivision or dedication or portion <br /> 25 thereof that has previously received tentative approval. <br /> 26 E. "Final plat" is the plan of the plat, subdivision, or dedication, or <br /> any portions thereof prepared for filing, for record with the county <br /> 27 auditor, and containing those elements and requirements set forth <br /> in this title. After the county auditor has filed for record the final <br /> 28 plat, it shall be known as an authorized plat, subdivision or <br /> dedication. <br /> 29 F. "Official plans" are those official maps or map, or portions thereof, <br /> 30 adopted by ordinance by the city council as provided in RCW <br /> 35.63.110, as hereafter amended. <br /> 31 <br /> 32 <br />
