• <br /> • <br /> 1 5. Divisions of land due to condemnation or sale under threat thereof, <br /> by an agency or division of government vested with the power of <br /> 2 condemnation. <br /> 3 6. Divisions of land into lots or tracts each of which is one-one <br /> hundred twenty-eighth of a section of land or larger, or five acres <br /> 4 or larger if the land is not capable of description as a fraction of a <br /> section of land. <br /> 5 <br /> 7. Divisions not to be used for building purposes (road right-of-way, <br /> 6 community open space, etc.) <br /> 7 be and the same is hereby amended to read as follows: <br /> 8 <br /> 9 Section 020: Exemptions <br /> 10 The provisions of this Chapter shall not apply to: <br /> 11 1. Cemetaries and other burial plots while used for that purpose. <br /> 12 2. Divisions made by testamentary provisions, the laws of descent, or <br /> upon court order. <br /> 13 3. Any division of land into five or more lots, parcels or tracts. <br /> 14 4. A division made for the purpose of adjusting boundary lines which <br /> 15 does not create any additional lot, tract, parcel, site, or division <br /> nor create any lot, tract, parcel, site or division which contains <br /> 16 insufficient area and dimension to meet minimum requirements for <br /> width and area for a building site and is done according to the <br /> 17 requirements of this Title. <br /> 18 5. Divisions of land due to condemnation, or sale under threat <br /> thereof, by any agency or division of government vested with the <br /> 19 power of condemnation. <br /> 20 6. Non-residential subdivision with Binding Site Plan (as defined in <br /> the Subdivision Code) and which meets the requirements of Ordi- <br /> nance No. 753-81. (SEPA - as it presently is or is hereafter <br /> amended). <br /> 22 7. Divisions not to be used for building purposes (road right-of-way, <br /> 23 community open space, etc.) <br /> 24 Section 3: Ordinance No. 517-78 is hereby amended by the addition of the <br /> 25 following section: <br /> 26 <br /> Boundary Line Adjustments <br /> 27 <br /> 1. Pre-Application Conference. The applicant shall have a <br /> 28 pre-application conference with the Planning Department. <br /> 29 2. Documents - Fees. The applicant shall fully complete and submit <br /> all application documents to the satisfaction of the Planning <br /> 30 Department and shall pay the required fee of $100. <br /> 31 <br /> 32 <br /> -3- <br />
