1 Any applicant, aggrieved by the decision of the City Engineer relating to a short subdivision, may request review of the City Council. 2 Such request must be made in writing to the City Clerk within twenty working days from the date on which the City Engineer presents the 3 applicant with the final decision in writing. 4 by and the same is hereby amended to read as follows: 5 6 Any applicant, aggrieved by the decision of the City relating to a short subdivision, may request review by the Hearing Examiner. Such 7 request must be made in writing to the Planning Department within twenty working days from the date on which the applicant receives a final 8 written decision. 9 Section 7: Ordinance No. 517-78 is hereby amended by the addition of the 10 following section: 11 12 Short Subdivisions of land with existing structures - When short subdivisions are submitted proposing the creation of 13 new lots with existing structures, the existing structures shall comply with all zoning code requirements including such things as 14 setbacks, parking requirements, and height standards. In addition, the existing structures must be compatible with existing structures 15 within the immediate vicinity of the proposed short subdivision. 16 Section 8: Ordinance No. 517-78 is hereby amended by the addition of the 17 following section: 18 19 It is expressly the purpose of the short subdivision code to provide for and promote the health, safety and welfare of the general public, and 20 not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited 21 by the terms of this Code. 22 It is the specific intent of this Code to place the obligation of complying with its requirements upon the applicant, and no provision of 23 nor term used in this Code is intended to impose any duty whatsoever upon the City or any of its officers or employees, for whom the 24 implementation or enforcement of this Code shall be discretionary and not mandatory. 25 Nothing contained in this Code is intended to be nor shall be 26 construed to create or form the basis for any liability on the part of the City, its officers, employees or agents, for any injury or damage resulting 27 from the failure of a short subdivision or short plat to comply with the provisions of this Code, or by reason or in consequence of any inspection, 28 notice, order, certificate, permission or approval authorized or issued or done in connection with the implementation or enforcement of this Code, 29 or by reason of any action or inaction on the part of the City related in any manner to the enforcement of this Code by its officers, employees or 30 agents. 31 32 -6-
