1 Any applicant, aggrieved by the decision of the City Engineer <br /> relating to a short subdivision, may request review of the City Council. <br /> 2 Such request must be made in writing to the City Clerk within twenty <br /> working days from the date on which the City Engineer presents the <br /> 3 applicant with the final decision in writing. <br /> 4 <br /> by and the same is hereby amended to read as follows: <br /> 5 <br /> 6 Any applicant, aggrieved by the decision of the City relating to a <br /> short subdivision, may request review by the Hearing Examiner. Such <br /> 7 request must be made in writing to the Planning Department within <br /> twenty working days from the date on which the applicant receives a final <br /> 8 written decision. <br /> 9 <br /> Section 7: Ordinance No. 517-78 is hereby amended by the addition of the <br /> 10 <br /> following section: <br /> 11 <br /> 12 Short Subdivisions of land with existing structures - <br /> When short subdivisions are submitted proposing the creation of <br /> 13 new lots with existing structures, the existing structures shall <br /> comply with all zoning code requirements including such things as <br /> 14 setbacks, parking requirements, and height standards. In addition, <br /> the existing structures must be compatible with existing structures <br /> 15 within the immediate vicinity of the proposed short subdivision. <br /> 16 Section 8: Ordinance No. 517-78 is hereby amended by the addition of the <br /> 17 following section: <br /> 18 <br /> 19 It is expressly the purpose of the short subdivision code to provide <br /> for and promote the health, safety and welfare of the general public, and <br /> 20 not to create or otherwise establish or designate any particular class or <br /> group of persons who will or should be especially protected or benefited <br /> 21 by the terms of this Code. <br /> 22 It is the specific intent of this Code to place the obligation of <br /> complying with its requirements upon the applicant, and no provision of <br /> 23 nor term used in this Code is intended to impose any duty whatsoever <br /> upon the City or any of its officers or employees, for whom the <br /> 24 implementation or enforcement of this Code shall be discretionary and <br /> not mandatory. <br /> 25 Nothing contained in this Code is intended to be nor shall be <br /> 26 construed to create or form the basis for any liability on the part of the <br /> City, its officers, employees or agents, for any injury or damage resulting <br /> 27 from the failure of a short subdivision or short plat to comply with the <br /> provisions of this Code, or by reason or in consequence of any inspection, <br /> 28 notice, order, certificate, permission or approval authorized or issued or <br /> done in connection with the implementation or enforcement of this Code, <br /> 29 or by reason of any action or inaction on the part of the City related in <br /> any manner to the enforcement of this Code by its officers, employees or <br /> 30 agents. <br /> 31 <br /> 32 <br /> -6- <br />
