1 ORDINANCE NO. 21) f - <br /> 2 <br /> AN ORDINANCE granting to the Burlington Northern Railroad Company <br /> 3 (formerly Burlington Northern, Inc.), its successors and assigns, the <br /> right, privilege and authority to locate, lay down, construct, <br /> 4 maintain and operate for a period of twenty-five (25) years from <br /> and after this ordinance becomes effective, railroad spur tracks <br /> 5 along, over and across Norton Avenue between 13th Street and <br /> 14th Street extended westerly, in the City of Everett, Washington, <br /> 6 and granting to said Company, its successors and assigns, rights of <br /> way for such tracks. <br /> 7 <br /> 8 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 9 <br /> Section 1: The City of Everett does hereby grant to the Burlington Northern <br /> 10 <br /> Railroad Company, its successors and assigns, for a period of twenty-five (25) years, <br /> 11 <br /> from and after 1981, the right, privilege and authority to locate, lay down, construct, <br /> 12 <br /> maintain and operate railway tracks of standard gauge, as hereinbelow designated and <br /> 13 <br /> specified, along, over and across Norton Avenue between 13th Street and 14th Street <br /> 14 <br /> extended westerly in said City; and also a right of way for said tracks along, over and <br /> 15 <br /> across said avenue and streets, which said right of way shall be seventeen (17) feet in <br /> 16 <br /> width for each such track herein authorized, lying eight and one-half (8-1/2) feet on <br /> 17 <br /> each side of the center line of such track. <br /> 18 <br /> Section 2: The tracks of standard gauge railway, the laying down, construe- <br /> 19 <br /> tion, maintenance and operation whereof are authorized by this ordinance, and the <br /> 20 <br /> rights of way hereby granted for the same, are described as follows: <br /> 21 <br /> 1. The track of standard gauge railway and a right of way therefor seventeen <br /> 22 <br /> (17) feet in width, the center line of which right of way is described as follows: <br /> 23 <br /> 24 Beginning at a headblock in a proposed yard track parallel to and at 56 <br /> feet centers with the existing Burlington Northern main track to <br /> 25 Vancouver, B. C., opposite the established railway station 1934 plus 54.5, <br /> measured at right angles; thence northwesterly thru a No. 9 turnout 81 <br /> 26 feet to a heel of frog, making an angle of 6 degrees 22 minutes with said <br /> yard track; thence continuing northwesterly along a 12 degree curve to <br /> 27 the left over, along and across said Norton Avenue and into the Port of <br /> Everett property. <br /> 28 <br /> 29 2. One track of standard gauge railway and a right of way therefor <br /> 30 seventeen (17) feet in width, the center line of which right of way is described as <br /> 31 follows: <br /> 32 -1- <br />
