• <br /> 1 Beginning at a headblock in above mentioned yard track parallel to and 56 <br /> feet centers with said main track opposite established main track station <br /> 2 1940 plus 47.2, measured at right angles; thence southwesterly thru a No. <br /> 9 turnout 81 feet to a heel of frog, making an angle of 6 degrees 22 <br /> 3 minutes with said yard track; thence continuing southwesterly along a 13 <br /> degree curve to the right over, along and across said Norton Avenue and <br /> 4 into the Port of Everett property. <br /> 5 <br /> Section 3: That wherever said tracks cross the paved portion of Norton <br /> 6 <br /> Avenue, said grantee shall resurface with asphaltic concrete any portions of the <br /> 7 <br /> existing paving which are disturbed in the construction of said tracks. Whenever the <br /> 8 <br /> City of Everett shall decide by ordinance, resolution or other official City Council <br /> 9 <br /> action to replace, renew, or widen the existing paving at the location herein described, <br /> 10 <br /> it shall be the duty of the grantee, its successors or assigns, to pave, at its own cost and <br /> 11 <br /> expense, all the space lying between the outer rails of said tracks and for one (1) foot <br /> 12 <br /> on the outside of each outer rail, to the full width of the paved portion of said avenue, <br /> 13 <br /> of such material, or in such manner as may be prescribed by said City, and under the <br /> 14 <br /> direction and inspection of such persons as may be appointed by the City for that <br /> 15 <br /> purpose; and such improvement shall thereafter be maintained in good repair at the <br /> 16 <br /> expense of the grantee. <br /> 17 <br /> Section 4: That wherever the said tracks cross or are to be crossed by a street <br /> 18 <br /> or avenue now constructed or to be hereafter constructed, laid out or extended, said <br /> 19 <br /> grantee agrees that in the event the City desires to improve said street or avenue by <br /> 20 <br /> paving, installation or water mains or sewer lines, or other public utilities, it will make <br /> 21 <br /> such adjustments as are necessary to accommodate said public improvement. <br /> 22 <br /> Section 5: That the said grantee, its successors and assigns, will not allow its <br /> 23 locomotives or cars to stand upon the track in Norton Avenue longer than ten minutes <br /> 24 at any one time and in no event longer than reasonably necessary to make switches or <br /> 25 make up or divide trains, or to receive or land passengers, load or unload freight, unless <br /> 26 in case of accident. <br /> 27 The grantee further agrees that it shall immediately remove all locomotives and <br /> 28 cars standing upon the track in Norton Avenue to permit the passage of emergency <br /> 29 vehicles on emergency calls. <br /> 30 The grantee also agrees that it will erect such signs and signal devices as are <br /> 31 reasonably necessary to protect life and property. <br /> 32 <br /> -2- <br />
