• r • , <br /> • <br /> 1 Section 6: Each applicant shall be required to post a continuing cash bond or <br /> 2 surety bond in the amount of $10,000 to assure the City of Everett of licensee's full <br /> 3 performance of all requirements under this ordinance including any past due payments <br /> 4 as required under Section 5 of this ordinance. At the expiration of the license period, <br /> 5 the cash bond shall be returned to the permittee upon written request therefor or the <br /> 6 permittee may authorize said bond to be retained to secure a subsequent license. <br /> 7 Licensee shall be responsible for negligent or non-negligent damaging by the <br /> 8 licensee of property owned or used by the City of Everett and all costs incurred by the <br /> 9 City of Everett as a result of any failure of the licensee to comply with the terms of <br /> 10 the license. Failure to pay damages to the City upon demand shall be grounds for <br /> 11 revocation of this license. <br /> 12 Section 7: Each licensee shall hold harmless the City of Everett, its agents, <br /> 13 officials and employees against all claims arising out of all operations relating to <br /> 14 disposal of material into the City of Everett sewage system pursuant to this ordinance <br /> 15 and each applicant shall submit an insurance certificate with a loss-payee clause <br /> 16 demonstrating bodily injury and property damage liability insurance with combined <br /> 17 single limits of $500,000 each occurrence and said certificate will include the City as a <br /> 18 named insured under said policy. Nothing herein shall in any manner preclude the <br /> 19 applicant from obtaining such additional insurance coverage as he may deem necessary <br /> 20 for his own protection. Cancellation of the required insurance shall be grounds for <br /> 21 immediate revocation of the license. The City shall be entitled to 30 days notice prior <br /> 22 to cancellation. <br /> 23 Section 8: The Sewer Superintendent is hereby authorized to designate the <br /> 24 points of disposal of materials collected by the licensees. The Sewer Superintendent or <br /> 25 the City Clerk is further authorized to revoke or suspend licenses for failure to comply <br /> 26 with the provisions of this ordinance, subject to the right of persons affected to appeal <br /> 27 from such revocation or suspension to City Council pursuant to the provisions of EMC <br /> 28 5.04.080(B) as it is or is hereafter amended. The licensee shall complete a Discharge <br /> 29 Form and return said form to the septic dump site operator prior to any discharge from <br /> 30 permittee's vehicle. Upon approval of Discharge Form by septic dump site operator, <br /> 31 the licensee may discharge into the specified dump site manhole. <br /> 32 -4- <br />
