All other <br /> 2 provisions of this ordinance shall apply to all licensees who have valid licenses as of the <br /> 3 1st day of October, 1981. <br /> 4 Section 15: Ordinance No. 263-73 and all amendments thereto are hereby <br /> 5 repealed. <br /> 6 Section 16: It is expressly the purpose of this ordinance to provide for and <br /> 7 promote the health, safety and welfare of the general public, and not to create or <br /> 8 otherwise establish or designate any particular class or group of persons who will or <br /> 9 should be especially protected or benefited by the terms of this ordinance. <br /> 10 It is the specific intent of this ordinance to place the obligation of complying <br /> 11 with its requirements upon the licensee, and no provision nor term used in this <br /> 12 ordinance is itended to impose any duty whatsoever upon the City or any of its officers <br /> 13 or employees, for whom the implementation or enforcement of this ordinance shall be <br /> 14 discretionary and not mandatory. <br /> 15 Nothing contained in this ordinance is intended to be nor shall be construed to <br /> 16 create or form the basis for any liability on the part of the City, or its officers, <br /> 17 employees or agents, for any injury or damage resulting from the failure of a licensee <br /> 18 to comply with the provisions of this ordinance, or by reason or in consequence of any <br /> 19 inspection, notice, order, certificate, permission or approval authorized or issued or <br /> 20 done in connection with the implementation or enforcement of this ordinance, or by <br /> 21 reason of any action or inaction on the part of the City related in any manner to the <br /> 22 enforcement of this ordinance by its officers, employees or agents. <br /> 23 Section 17: If any section, sentence, clause or phrase of this ordinance should <br /> 24 be held invalid or unconstitutional, the invalidity or unconstitutionality thereof shall not <br /> 25 affect the validity or constitutionality of any other section, sentence, clause or phrase. <br /> 264 2 A.� <br /> 27 ATTEST: MAYOR <br /> 28 <br /> 29 ZLERK <br /> 30 Passed: -?6-a'/ <br /> 31 Valid: 9-a- P/ <br /> Published: 9•- 6-f/ <br /> 32 <br /> -6- <br />
