• <br /> C. Consultant Selection-for Draft EIS Information <br /> 1. The Responsible Official shall maintain a list of consultants qualified <br /> to prepare environmental impact statements. <br /> 2. Any applicant required to submit data for the Draft EIS shall be <br /> deemed to have fulfilled the requirements of this Ordinance by <br /> utilizing the services of a consultant included upon the responsible <br /> consultants' list, PROVIDED, that the Responsible Official delay <br /> distribution of the Draft EIS, when necessary, to correct any deficiencies <br /> in the data submitted, and that the consultant shall provide such <br /> information as is required under Section 14A of this Ordinance. <br /> 3. All fees and charges for said consultant shall be the responsibility <br /> of the applicant. <br /> 4. The Responsible Official shall accept for inclusion upon the responsible <br /> consultant list any person, firm, corporation, partnership or association <br /> which: <br /> a. Documents its expertise in engienering, planning, biology, <br /> zoology, geology, and other areas of analysis under WAC <br /> 197-10-444. <br /> b. Where the firm has had previous experience, provides one <br /> or more recommendatios from the lead agency involved in <br /> the prior experiences. <br /> 5. The Responsible Officials may, upon notification to an affected <br /> firm remove said firm from the consultants' list for good cause <br /> including incompetence, misrepresentation, insufficiency, bias, <br /> or gross failure to perform in accordance with this Ordinance. <br /> The firm shall have the opportunity to present arguments to the <br /> Responsible Official prior to the Responsible Officials' actions <br /> and may request a finding and determination in writing for the <br /> purpose of review. The firm may apply for reinstatement to the <br /> consultants' list after one year and shall be reinstated upon approval <br /> by the Responsible Official. <br /> D. Consultant/Applicant Responsibilities <br /> When a private applicant or consultant prepares a Draft EIS, the following <br /> responsibilities are hereby specified: <br /> 1. City communicates and meets with the developer. <br /> 2. City communicates and meets with the consultant. <br /> 3. Consultant submits information in the form of a Draft EIS. <br /> 4. City reviews the Draft EIS. <br />
