• <br /> • <br /> 3. Recommend to the Planning Commission or the City Council actions <br /> pursuant to publication of a Final Environmental Impact Statement. <br /> 4. Review the City's SEPA Ordinance and advise as to adequacy and <br /> compliance with SEPA Guidelines and recommend to the Mayor <br /> necessary changes and/or amendments to the Ordinance. <br /> 5. Advise the Mayor of any unresolved issues regarding the <br /> environmental effects of a proposed action which are not mitigated <br /> through the review process. <br /> 6. Give such other assistance to the Mayor and City Council as <br /> requested to fulfill the City's SEPA obligations. <br /> Section 22: Appeal Procedures <br /> A. In accordance with the provisions of Ordinance No. 692-80, the following <br /> City determinations and actions shall be subject to review on appeal to <br /> the Land Use Hearing Examiner. The decision of the Land Use Hearing <br /> Examiner shall be final unless an appeal in the form as set forth in sub- <br /> section "B" below is made to the City Council within ten days of the Land <br /> Use Hearing Examiner's decision. <br /> 1. A determination whether or not a project or proposal is an "action". <br /> 2. A determination as to scope of the total proposal; <br /> 3. A determination whether or not a project or proposal is <br /> categorically exempt; <br /> 4. A threshold determination; <br /> 5. Adoption of the Final EIS, as to adequacy; <br /> 6. The issuance of a document denying or conditioning an action based <br /> upon specific adverse environmental impacts; <br /> 7. Final action on a project or proposal, as to compliance with the <br /> provisions of this Ordinance. <br /> 8. A determination to exclude or remove a consultant from the <br /> consultant list. <br /> B. Any person aggrieved by any of the determinations or actions by the <br /> Responsible Official as described in Subsection "A" above, may appeal to <br /> the Land Use Hearing Examiner by submitting to the City Clerk a written <br /> statement requesting an appeal which sets forth the name and address of <br /> the person aggrieved and a clear and concise statement of the grounds for <br /> the appeal. Any appeal from such a determination or action must be filed <br /> with the City Clerk no later than fifteen days following the filing of such <br /> determination or action as required in subsection "C" below. <br /> C. Notice of all determinations and actions described in subsection "A" above <br /> shall be filed immediately by the Responsible Official in the City's SEPA <br /> Public Information Center. <br />
