To construct a street-access driveway at their 3514 Wetmore Avenue property,the <br /> Brashlers must be granted variances from EMC 13.16.050(F)and EMC 19.33G.050(B)(1). <br /> 2. The Everett City Council granted the Brashlers;a variance from EMC <br /> 13.16.050(F)on September 17,2014: <br /> 3. The Brashlers were never granted a variance from EMC I9.33G.050(B)(1)and <br /> that restriction prevents issuance of a public works permit. <br /> CONCLUSIONS <br /> 1. EMC 19.41.130 allows the Hearing Examiner to grant variances when certain <br /> conditions are satisfied. <br /> 2. Approval of a variance from EMC 19.33G.050(B)(1)is warranted in this matter <br /> based on the findings of fact,conclusions of law,and conclusions contained in the July 16,2014 <br /> Findings and Recommendation issued herein. <br /> ORDER <br /> Based on the Findings and Conclusions as stated above,the following Order is issued: <br /> Michael and Terri Brashler,the owners of 3514 Wetmore Avenue,are hereby granted a valiance <br /> from the restrictions contained in EMC 19.33G,050(B)(1).Assuming that all other conditions are <br /> satisfied,the City should issue a public works permit allowing the Brashlers to construct a street- <br /> access driveway at their 3514'Wetmore Avenue property. <br /> Done and dated this 50 day of e ,20.14. <br /> ,f James M.Miscall <br /> Violations Hearing Examiner <br /> r`` City of Everett <br />
