f.. <br /> CITY ATTORNEY'S <br /> OFFICE <br /> In the Matter of the Application <br /> Of Michael and Terri Brashler <br /> For Approval.of a Variance Variance 414-002 <br /> City's Request for a Supplemental Order <br /> Dear Hearing Examiner Driscoll, <br /> You will no doubt recall the convoluted matter of the Brashlers'request for the proper variances <br /> to allow them to.construct a street-access driveway at their 3514 Wetmore Avenue property.The <br /> City is currently requesting that you issue a supplemental order in this matter formally granting <br /> the Brashlers' a variance from the restriction of EMC I933G.050(B)(l). <br /> 1. Restrictions at Issue <br /> The Brashlers sought to build a street-access driveway at their 3514 Wetmore Avenue property. <br /> Because the Brashlers'property is located within the Core Residential area,two independent <br /> provisions of the Everett Municipal Code restricted their ability to construct a street-access <br /> driveway,and they were required to seek two independent variances. <br /> Core Residential Standards--The Brashlers'property is located within the core residential area <br /> and the core residential standards provide for alley-access driveways.EMC I9.33G.050(B)(1). <br /> Under EMC 19.41.130,a variance from the restrictions of EMC I9.33G.050(B)(1)is available <br /> from the City Hearing Examiner. <br /> • <br /> General Driveway Regulations—EMC 13.16.050(F)is a regulation that applies throughout the <br /> City and provides a preference for alley-access driveways.Under EMC 13.16.110,a variance <br /> fromthe restrictions of EMC 13.16.050(F)is available from the City Council. <br /> 2. Background <br /> The Brashlers properly sought a variance from the Core Residential Standards(EMC <br /> 19.330.050(B)(1))from the City Hearing Examiner.The matter was heard on July 3,2014..In <br /> your July 16,2014 Findings and Recommendation,you.did not approve a variance from the.Core <br /> Residential Standards,but recommended that the Everett City Council approve a variance from <br /> the City's General Driveway Regulations(EMC 13.16.050(F)).At that time,neither of the two <br /> CITY OF EVERETT•2930 Wetmore Ave.• Everett,WA 98201 •(425)257-7000• Fax(425)257-8693 <br />
