FINDINGS AND RECOMMENDATION <br /> OF THE HEARING EXAMINER OF THE <br /> CITY OF EVERETT <br /> IN THE MATTER OF THE APPLICATION <br /> OF MICHAEL AND TERRI BRASHLER <br /> FOR APPROVAL OF A VARIANCE VARIANCE#14-002 <br /> SUMMARY OF <br /> RECOMMENDATION: It is hereby recommended to the Everett <br /> City Council that a variance be granted to <br /> Michael and Terri Brashler to allow <br /> vehicular access off 3514 Wetmore <br /> Avenue, Everett, Washington. The <br /> variance should be granted subject to the <br /> conditions as hereby listed in this <br /> document. <br /> INTRODUCTION <br /> Everett Municipal Code (EMC) 19.33G.050.B.1 establishes that sites abutting alleys are <br /> required to gain vehicular access from the alley and that no driveway access from the <br /> public street is allowed. Michael and Terri Brashler (Applicant) are the property owners <br /> at 3514 Wetmore Avenue, Everett, Washington 98201 (subject property). The property, <br /> zoned R-3 Multiple Family Medium Density and Core Residential Area, is developed <br /> with a single-family residence. The Applicant seeks a variance from the provisions of <br /> the Core Residential Development Standards, EMC 19.33G.050.B.11 in order to have <br /> street access for a new garage. A variance from this section requires a decision from <br /> the Everett City Council for final approval of the driveway for properties with alley <br /> access. <br /> A hearing on the request was held before the Hearing Examiner of the City of Everett on <br /> July 3, 2014. At the hearing the following presented testimony and evidence: <br /> Teresa Weldon, City of Everett Planning Department <br /> Michael Brick, City of Everett Traffic Engineer <br /> Michael and Terri Brashler, Applicant <br /> 3514 Wetmore Avenue <br /> Everett, WA 98201 <br /> At the hearing the following exhibits were submitted and were admitted as part of the <br /> official record of these proceedings: <br /> 1 EMC 13.16.050.F states "No permit for a driveway approach shall be granted where reasonable <br /> egress and ingress,for the purpose for which the property-is used, can be secured from the alley." <br />
