1 <br /> I CITY OF EVERETT PUBLIC WORKS 00 21 13 <br /> SPECIAL PROVISIONS INSTRUCTIONS TO BIDDERS <br /> I1.19 DURATION OF OFFER <br /> A. Bids shall remain open to acceptance and shall be irrevocable for a period of 45 calendar days <br /> after Bid closing date. <br /> I <br /> 1.20 EVALUATION OF BIDS <br /> IA. Bids will be evaluated by the City to determine which bid is the lowest responsive bid by a <br /> responsible bidder and which bid, if any, should be accepted in the best interest of the City. <br /> I 1. The City will award the Project to the responsive and responsible bidder whose Bid is the <br /> lowest. <br /> a. In accordance with RCW 39.04.380, if a bid is received from a nonresident <br /> I contractor from a state that provides an in-state percentage bidding preference and <br /> does not have an office located in Washington, then a comparable percentage <br /> disadvantage will be applied to the bid of that nonresident contractor. <br /> 1 2. To determine Bidder responsiveness, City will consider all the material submitted by the <br /> bidder to determine whether it is in compliance with the Contract Documents. <br /> a. The City reserves the right,at its discretion,to reject nonresponsive Bids. <br /> I3. Bidder shall meet all Mandatory Responsibility Criteria(RCW 39.04.350(1))as follows: <br /> a. Have a current certificate of registration as a contractor in compliance with Chapter <br /> I 18.27 RCW,which must have been in effect at the time of bid submittal; and <br /> b. Have a current Washington Unified Business Identifier(UBI)number; and <br /> c. Have following State Requirements, if applicable <br /> 1) Have Industrial Insurance (workers' compensation coverage for bidder's <br /> I employees working in Washington, as required in Title 51 RCW; and <br /> 2) Have a Washington Employment Security Department number,as required in <br /> Title 50 RCW;and <br /> I 3) Have a Washington Department of Revenue state excise tax registration <br /> number, as required in Title 82 RCW;and <br /> d. Not be disqualified from bidding on any public works contract under RCW <br /> 39.06.010 or 39.12.065(3). <br /> I e. Have not been found out of compliance by the Washington state apprenticeship and <br /> training council for working apprentices out of ratio, without appropriate <br /> supervision, or outside their approved work processes as outlined in their standards <br /> I of apprenticeship under chapter 49.04 RCW for the one-year period immediately <br /> preceding the date of the bid solicitation, if the Project is subject to the <br /> apprenticeship utilization requirements in RCW 39.04.320. <br /> If. Within the three-year period immediately preceding the date of the bid solicitation, <br /> not have been determined by a final and binding citation and notice of assessment <br /> issued by the department of labor and industries or through a civil judgment entered <br /> by a court of limited or general jurisdiction to have willfully violated, as defined in <br /> IRCW 4948082,any provision of chapter 4946,4948,or 4952 RCW. <br /> 4. Bidder shall meet all Supplemental Bidder Responsibility Criteria(RCW 39.04.350(2))as <br /> I noted in Document 00 22 13 - Supplemental Instructions To Bidders. <br /> a.
