CITY OF EVERETT PUBLIC WORKS 00 21 13 <br /> SPECIAL PROVISIONS INSTRUCTIONS TO BIDDERS <br /> B. The City, in its sole discretion, reserves the right to accept or reject any and all bids submitted <br /> and to waive informalities and minor irregularities. <br /> 1.21 BID PROTESTS <br /> A. All protests by Bidders must be in accordance with Everett Municipal Code 3.46, "Bid Protest <br /> Procedures." 1 <br /> 1.22 PRE-AWARD CONFERENCE <br /> A. After Bid opening, but prior to award, the apparent successful Bidder shall, if requested by the <br /> City, attend a pre-award conference to respond to questions by the City regarding evaluation of <br /> Bids. I <br /> 1. The City will emphasize items such as insurance and bonding that will assist in prompt <br /> issuance of the Notice to Proceed. <br /> 2. By conducting a pre-award conference, the City has not thereby waived its right to make <br /> determinations regarding responsiveness and responsibility of the Bidder. <br /> 1.23 ACCEPTANCE OF BID <br /> A. Within 45 days after the opening of Bids,the City will act either to accept the Bid from the lowest , <br /> responsive, responsible Bidder, or to reject all Bids. <br /> 1. The City reserves the right to request extensions of such Bid acceptance period. I <br /> B. After acceptance by Owner, City's Project Manager, on behalf of Owner, will issue to the <br /> accepted Bidder a written Notice of Award of Contract. <br /> 1. Notice of Award of Contract will be delivered in person or by certified mail to the Bidder <br /> whose Bid is accepted. <br /> 2. Notice of Award of Contract will also include a request to furnish a performance and <br /> payment bond and evidence of insurance and to execute the Contract set forth in the <br /> Contract Documents. <br /> C. Notwithstanding delay in the preparation and execution of the Contract,accepted Bidder shall be <br /> prepared,upon written Notice to Proceed,to commence Work within 30 calendar days following <br /> receipt of official written order of Owner to proceed, or on date stipulated in such order. , <br /> D. Bidder has 14 calendar days after receiving the Notice of Award to submit the following <br /> documents to the City: <br /> 1. Two executed copies of the Contract. <br /> 2.
