37. Owner: The City of Everett, Washington. "Owner"and the"City" mean the same. <br /> 38. Owner's Representative: The person designated in writing and employed or retained by <br /> the Owner to act as its representative at the construction Site and to perform construction <br /> inspection service and administrative functions relating to this Contract. The terms <br /> "Owner's Representative", "Engineer"and"Architect"are interchangeable. <br /> 39. Person: Includes individuals, associations, firms, companies, corporations, partnerships, <br /> and joint ventures. <br /> 40. Physical Completion: Physical Completion Date is the day all of the Work is physically <br /> completed on the Project. All documentation required by the Contract and required by law <br /> does not necessarily need to be furnished by the Contractor by this date. <br /> 41. Progress Schedule: A schedule prepared and maintained by Contractor, describing the <br /> sequence and duration of the activities comprising the Contractor's plan to accomplish the <br /> Work within the Contract Time. I <br /> 42. Project: The undertaking to be performed under the provisions of the Contract. <br /> 43. Punch List: List of incomplete items of Work and of items of Work that are not in <br /> conformance with the Contract Documents,prepared after Substantial Completion. <br /> 44. RCW: Means the Revised Code of Washington. <br /> 45. Samples: Physical examples of materials, Equipment, or workmanship that are <br /> representative of some portion of the Work and which establish the standards by which such <br /> portion of the Work will be judged. <br /> 46. Schedule of Values: Allocation of Contract Sum to items of Work as provided in 9.1.A. <br /> Schedule of Values. <br /> 47. Shall: Required conduct. <br /> 48. Shop Drawings: All drawings, diagrams, illustrations, schedules, and other data or <br /> information, which are specifically prepared or assembled by or for Contractor and <br /> submitted by Contractor,to illustrate some portion of the Work. <br /> 49. Shown: Refers to information presented on the Drawings, with or without reference to the <br /> Drawings. <br /> 50. Site: Lands or areas indicated in the Contract Documents as being furnished by Owner upon <br /> which the Work is to be performed, including rights-of-way and easements for access <br /> thereto, and such other lands furnished by Owner that are designated for the use of <br /> Contractor. <br /> 51. Specifications: That part of the Contract Documents consisting of written descriptions of <br /> the technical features of materials, Equipment, construction systems, standards, and <br /> workmanship. <br /> 52. Specify: Refers to information described, shown, noted or presented in any manner in any <br /> part of the Contract Documents. <br /> 53. Subcontractor: An individual or entity having a direct contract with Contractor or with any <br /> other Subcontractor for the performance of a part of the Work. <br /> 54. Submittals: The information required by the Contract Documents provided by Contractor <br /> to the Owner's Representative or Owner. ' <br /> 55.
