1 Contractor Responsibility <br /> 2 The CONTRACTOR shall furnish to each BOARD member, one copy of all <br /> 3 pertinent documents which are or may become necessary for the BOARD to <br /> 4 perform their function. Pertinent documents may include any drawings or sketches, <br /> 5 calculations, procedures, schedules, estimates, or other documents which are <br /> 6 created in the planning or the performance of the contract work. Copies of any <br /> 7 documents provided to the BOARD must also be furnished to the STATE. <br /> 8 <br /> 9 State.Responsibility <br /> 10 The STATE shall furnish the following services and items: <br /> 11 <br /> 12 A. Contract-Related Documents: The STATE shall furnish the BOARD three <br /> 13 copies of the contract documents, including change orders, written <br /> 14 instructions issued by the STATE to the CONTRACTOR, or other <br /> 15 documents pertinent to the performance of the contract, and therefore, <br /> 16 necessary to the BOARD's work. <br /> 17 <br /> 18 B. Coordination and Services: The STATE's project engineer for the contract <br /> 19 will, in cooperation with the CONTRACTOR, coordinate the operations of <br /> 20 the BOARD. The STATE, through the project engineer, will arrange or <br /> 21 provide conference facilities at or near the contract site and provide <br /> 22 secretarial and copying services. <br /> 23 <br /> 24 Suggested Administrative Procedures <br /> 25 Objective <br /> 26 The principal objective of the BOARD is to assist in the resolution of disputes, <br /> 27 which would otherwise be submitted to litigation processes, and encourage the <br /> 28 STATE and the CONTRACTOR to resolve issues at the lowest level possible. If this <br /> 29 objective is achieved, such disputes can be resolved promptly, with minimum <br /> 30 expense, and with minimum disruption to the administration and performance of the <br /> 31 work. It is not intended for the STATE or the CONTRACTOR to default on their <br /> 32 normal responsibility to amicably and fairly settle their differences by <br /> 33 indiscriminately assigning them to the BOARD. It is intended that the mere <br /> 34 existence of the BOARD will encourage the STATE and the CONTRACTOR to <br /> 35 resolve potential disputes without resorting to this appeal procedure. But when a <br /> 36 dispute which is serious enough to warrant the BOARD's review does develop, the <br /> 37 machinery for prompt and efficient action will already be in place. <br /> 38 <br /> 39 The BOARD, the STATE and the CONTRACTOR shall develop by agreement the <br /> 40 BOARD's rules of operations and procedures to be followed for the PROJECT. In <br /> 41 developing the agreement, the parties shall take into consideration their respective <br /> 42 duties and responsibilities as set forth in their various agreements. Below are <br /> 43 definitions of the responsibilities of theBOARD, and general guidelines which may <br /> 44 be considered in developing the rules of operations and procedures for the <br /> 45 BOARD.These guidelines express, in general terms,the policy for the creation and • <br /> 46 operation of the BOARD based on the STATE's Standard Specification 1-09.11(1), <br /> 47 and any modification to that Standard Specification in the Special Provisions of the <br /> 48 construction Contract. <br /> 49 <br /> 50 Responsibility of the BOARD <br /> 51 The BOARD will render findings and recommendations on disputes between the <br /> CITY OF EVERETT <br /> GRAND AVENUE PARK BRIDGE July 2017 <br /> WO#3688 Appendix J—2 i! <br />
