WHEREAS, the Everett City Council on February 27, 1980, passed <br /> Ordinance No. 669-80, and on July 30, 1980, passed Ordinance No. 714-80, <br /> and Ordinance 715-80, and August 13, 1980, passed Ordinance No. 722-80, <br /> which established increased sewer connection charges for new construction <br /> in the City to contribute toward payment for needed increases in sewer <br /> transmission and treatment capacity within available funding; and <br /> WHEREAS, under the SEPA process, new subdivisions and other major <br /> developments are required to pay a systems development fee to mitigate <br /> their impact on the Everett sewer system; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE EVERETT CITY <br /> COUNCIL THAT: <br /> Section 1: A special fund is hereby established as Fund No. 345 <br /> entitled "Southwest Everett Sewer L.I.D. Preliminary Engineering <br /> Fund" to accomplish the actions authorized in subsequent sections <br /> of this ordinance. <br /> Section 2: Authorization is hereby granted to the Public Works <br /> Director to provide for planning, design, and contract administration <br /> necessary to accomplish completion of all work preliminary to formation <br /> of an L.I.D. for Southwest Everett sewer improvements. <br /> Section 3: The total estimated cost of the work herein authorized <br /> is $150,000 which will include all related costs for design, legal assistance, <br /> contract administration, plan development and associated costs. <br /> Section 4: The Public Works Director of the City of Everett under <br /> administration of the Mayor is hereby given the responsibility of <br /> conducting all tasks outlined under Section 2 above. <br /> Section 5: The City Treasurer of the City of Everett is hereby <br /> authorized to negotiate a reasonable rate of interest and issue interest <br /> bearing warrants to satisfy interim costs not to exceed $150,000. <br /> These interest bearing warrants shall be redeemed by the Treasurer <br /> as soon as reimbursement or long term bond financing monies, <br /> in this Ordinance, are received. <br /> Section 6: A. The sum, $150,000, is hereby appropriated to Fund <br /> No. 345, "Southwest Everett Sewer L.I.D. Preliminary <br /> Engineering Fund" as follows: <br /> Program 797 - Southwest Everett L.I.D. Preliminary <br /> Engineering - $150,000. <br /> B. The source of funds for the appropriations to Program <br /> Number 797 shall be Sewer Department Fund 404 in <br /> the amount of $150,000. <br /> C. This appropriation shall not lapse but shall be carried <br /> forward from year-to-year until fully expended or <br /> the purpose has been accomplished or abondoned without <br /> the necessity of reappropriation as per R.C.W. 35.33.151. <br /> D. If the Southwest Everett Sewer L.I.D. proceeds, Sewer <br /> Department Fund 404 shall be reimbursed by the L.I.D. <br /> in the amount of $150,000. <br /> -2- <br />
