idf, 36, , <br /> 1 ORDINANCE NO. -77.-g b <br /> 2 <br /> AN ORDINANCE adopting by reference the State of Washington 1980 <br /> 3 Energy Code. <br /> 4 <br /> 5 <br /> WHEREAS, the City of Everett finds that it is in the public interest to provide <br /> 6 <br /> minimum standards for new buildings and structures or portions thereof to achieve <br /> 7 <br /> efficient use of energy; <br /> 8 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 9 <br /> Section 1: The 1980 State Energy Code as promulgated by the State of <br /> 10 <br /> Washington is hereby adopted by reference together with any amendments thereof or <br /> 11 <br /> additions thereto. <br /> 12 <br /> Section 2: Subsection (c) of Section 106 of the State Energy Code is hereby <br /> 13 <br /> amended to read as follows: <br /> 14 <br /> 15 (c) The Building Official shall accept the professional stamp of an <br /> architect or engineer licensed to do business in the state in lieu of <br /> 16 a plan and specification check if the engineer or architect <br /> stipulates to the best of his knowledge, understanding, and belief, <br /> 17 the design meets the requirements of this Code. <br /> 18 <br /> Section 3: Section 109 of the State Energy Code is hereby amended by the <br /> 19 <br /> addition of the following: <br /> 20 <br /> 21 Any person, firm or corporation violating any provision of this Code <br /> shall be deemed guilty of a misdemeanor and, upon conviction thereof, <br /> 22 shall be punishable by a fine not to exceed $500 or by imprisonment in jail <br /> not to exceed 6 months, or both fine and imprisonment. Each separate <br /> 23 day or any portion thereof, during which any violation of this Code occurs <br /> or continues, shall be deemed to constitute a separate offense and, upon <br /> 24 conviction thereof, shall be punishable as herein provided. The issuance or <br /> granting of a permit or approval of plans and specifications shall not be <br /> 25 deemed or construed to be a permit for, or an approval of, any violation of <br /> any of the provisions of this Code. No permit presuming to give authority <br /> 26 to violate or cancel the provisions of this Code shall be valid, except <br /> insofar as the work or use which it authorized is lawful. <br /> 27 <br /> 28 Section 4: Section 110 of the State Energy Code is hereby amended to read as <br /> 29 follows: <br /> 30 <br /> 31 <br /> 32 <br />
