1 Liability <br /> 2 It is expressly the purpose of this Code to provide for and promote <br /> the health, safety and welfare of the general public, and not to create or <br /> 3 otherwise establish or designate any particular class or group of persons <br /> who will or should be especially protected or benefited by the terms of <br /> 4 this Code. <br /> It is the specific intent of this Code that no provision nor any term <br /> 5 used in this Code is intended to impose any duty whatsoever upon the City <br /> or any of its officers or employees, for whom the implementation or <br /> 6 enforcement of this Code shall be discretionary and not mandatory. <br /> Nothing contained in this Code is intended to be nor shall be <br /> 7 construed to create or form the basis for any liability on the part of the <br /> City, or its officers, employees or agents, for any injury or damage <br /> 8 resulting from the failure of a building to comply with the provisions of <br /> this Code, or by reason or in consequence of any inspection, notice, order, <br /> 9 certificate, permission or approval authorized or issued or done in <br /> connection with the implementation or enforcement of this Code, or by <br /> 10 reason of any action or inaction on the part of the City related in any <br /> manner to the enforcement of this Code by its officers, employees or <br /> 11 agents. <br /> 12 <br /> Section 5: If any section, sentence, clause or phrase of this Ordinance should <br /> 13 <br /> be held invalid or unconstitutional, the invalidity or unconstitutionality thereof shall not <br /> 14 <br /> affect the validity or constitutionality of any other section, sentence, clause or phrase. <br /> 15 <br /> 16 <br /> 17 <br /> MAYOR <br /> 18 <br /> ATTEST: <br /> 19 <br /> 20 <br /> CITY CLERK <br /> 21 <br /> 22 Passed: 9/3/5.o <br /> 23 Valid: 9/5'78 <br /> // <br /> 24 Published: 9/WS-6 <br /> 25 <br /> 26 <br /> 27 <br /> 28 <br /> 29 <br /> 30 <br /> 31 <br /> 32 -2- <br />
