10. The City Attorney's Office searched the case information for Snohomish County <br /> Superior Court as late as January 3, 2013, and found no evidence of a probate, <br /> being filed for the estate of Joyce Redmond. <br /> 11. After making a reasonable search for succeeding owner of the property and finding <br /> none, the City amended the violation citation to include all interested parties as <br /> Respondents in this matter, specifically the, "Estate of Joyce Redmond, Unknown <br /> Heirs and Unknown Devisees, all other occupants of the premises, and any other <br /> person or parties claiming to have right to title, estate lien, or interest in the property <br /> described in this violation citation". In accordance with EMC 1.20.010.C.1 notice <br /> was properly provided to the Respondents of the amended violation citation by <br /> mailing copies via first class and certified mail and posting the property with the <br /> amended violation citation on December 14, 2012. <br /> 12. The Respondent was given the opportunity to correct the conditions and received <br /> adequate notice to appear at this hearing to contest the City's findings. <br /> Based on the above Findings of Fact, the Violations Hearing Examiner enters the <br /> following Conclusions: <br /> CONCLUSIONS OF LAW <br /> Jurisdiction: <br /> Pursuant to Chapter 1.20 EMC or any Everett Municipal Code (EMC) provisions that <br /> identify Chapter 1.20 EMC for enforcement, the Violations Hearing Examiner of the City <br /> of Everett has jurisdictional authority to hold this hearing and to issue the decision. <br /> EMC§1.20.020 <br /> Applicable Law: <br /> 1. IPMC 604.1 as adopted by EMC 16.005.010: <br /> All plumbing fixtures shall be properly installed and maintained in working order, <br /> and shall be kept free form obstructions, leaks and defects and be capable of <br /> performing the function for which such fixtures are designed. All plumbing fixtures <br /> shall be maintained in a safe, sanitary and functional condition. <br /> 2. IPMC 505.3 as adopted by EMC 16.005.010: <br /> Water Supply <br /> The water supply system shall be installed and maintained to provide a supply of <br /> water to plumbing fixtures, devices and appurtenances in sufficient volume and at <br /> pressures adequate to enable the fixtures to function properly, safely, and free of <br /> defects and leaks. <br /> 3.
