All electrical equipment, wiring and appliances shall be properly installed and <br /> maintained in a safe and approved manner. <br /> 4. IPMC 108.1.1 as adopted by EMC 16.005.010: <br /> General <br /> When a structure or equipment is found by the code official to be unsafe, or when a <br /> structure is found to be unfit for human occupancy, or is found to be unlawful, such <br /> structure shall be condemned pursuant to the provision of this code. <br /> Unlawful Structure <br /> An unlawful structure is one found in whole or in part to be occupied by more <br /> persons than permitted under this code, or was erected, altered or occupied <br /> contrary to law. <br /> Conclusions of Law Based on Above Findinus:, <br /> 1. The failure to have water service provided to the property is a violation of IPMC <br /> 505.3. The code requires that water service be provided. <br /> 2. The failure to install and maintain an electrical system in an approved manner is a <br /> violation of IPMC 605.1. The code requires that all electrical equipment be properly <br /> installed in an approved manner. <br /> 3. The absence of working plumbing fixtures in the structure on the property is a <br /> violation of IPMC 504.1. The code requires that the structure contain plumbing <br /> fixtures that are properly installed and in good working order. <br /> 4. The absence of working adequate electrical system is a violation of IPMC 108.1.1. <br /> The code requires that structures be fit for human habitation. <br /> 5. The property is not fit or safe and is unsuitable to be occupied. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, the following <br /> Order is issued: <br /> 1. The Respondents as named in this document, shall abate all violations of IPMC <br /> 505.3 as adopted by EMC 16.005.010; IPMC 605.1 as adopted by EMC <br /> 16.005.010; IPMC 504.1 as adopted by EMC 16.005.010 and IPMC 108.1.1 as <br /> adopted by EMC 16.005.010. <br /> 2. All abatement of the violations on the above mentioned property shall be completed <br /> by January 17, 2013. Cleanup and abatement shall include: <br /> a. The Respondents as named in this document, shall vacate the residence <br /> no later than January 10, 2013 and properly secure it from entry, until <br /> 5 <br />
