1 Section 19: Section 102 of the Uniform Building Code, Section 102 of the <br /> 2 Uniform Mechanical Code, Section 1.102 of the Uniform Fire Code, Section 10.2 of the <br /> 3 Uniform Plumbing Code, and Article 90-1 of the National Electrical Code are hereby <br /> 4 amended by the addition to the following language: <br /> 5 <br /> It is expressly the purpose of this Code to provide for and promote <br /> 6 the health, safety and welfare of the general public, and not to create or <br /> otherwise establish or designate any particular class or group of persons <br /> 7 who will or should be especially protected or benefited by the terms of <br /> this Code. <br /> 8 <br /> It is the specific intent of this Code that no provision nor term used <br /> 9 in this Code is intended to impose any duty whatsoever upon the City or <br /> any of its officers or employees, for whom the implementation or <br /> 10 enforcement of this Code shall be discretionary and not mandatory. <br /> 11 Nothing contained in this Code is intended to be nor shall be <br /> construed to create or form the basis for any liability on the part of the <br /> 12 City, or its officers, employees or agents, for any injury or damage <br /> resulting from the failure of a building to comply with the provisions of <br /> 13 this Code, or by reason or in consequence of any inspection, notice, order, <br /> certificate, permission or approval authorized or issued or done in <br /> 14 connection with the implementation or enforcement of this Code, or by <br /> reason of any action or inaction on the part of the City related in any <br /> 15 manner to the enforcement of this Code by its officers, employees or <br /> agents. <br /> 16 <br /> 17 Section 20: That Section 201(c) of the Uniform Mechanical Code is hereby <br /> 18 amended by deleting: <br /> 19 <br /> (c) Right of Entry. Whenever it is necessary to make an <br /> 20 inspection to enforce the provisions of this code, or whenever the building <br /> official or his authorized representative has reasonable cause to believe <br /> 21 that there exists in any building or upon any premises any condition or <br /> violations of this code which make the building or premises unsafe, <br /> 22 dangerous or hazardous, the building official or his authorized <br /> representative may enter the building or premises at all reasonable times <br /> 23 to inspect or to perform the duties imposed upon the building official by <br /> this code, provided that if such building or premises be occupied he shall <br /> 24 present his credentials to the occupant and request entry. If such building <br /> or premises be unoccupied, he shall first make a reasonable effort to <br /> 25 locate the owner or other person having charge or control of the building <br /> or premises and request entry. If entry is refused the building official or <br /> 26 his authorized representative, he shall have recourse to every remedy <br /> provided by law to secure entry. <br /> 27 When the building official or his authorized representative shall <br /> have first obtained a proper inspection warrant or other remedy provided <br /> 28 by law to secure entry, no owner or occupant or person having charge, <br /> care or control of any building or premises shall fail or neglect, after <br /> 29 proper request is made as herein provided, to promptly permit entry <br /> therein by the building official or his authorized representative for the <br /> 30 purpose of inspection and examination pursuant to this code. <br /> 31 <br /> 32 -8- <br />
