1 Section 19: Section 102 of the Uniform Building Code, Section 102 of the 2 Uniform Mechanical Code, Section 1.102 of the Uniform Fire Code, Section 10.2 of the 3 Uniform Plumbing Code, and Article 90-1 of the National Electrical Code are hereby 4 amended by the addition to the following language: 5 It is expressly the purpose of this Code to provide for and promote 6 the health, safety and welfare of the general public, and not to create or otherwise establish or designate any particular class or group of persons 7 who will or should be especially protected or benefited by the terms of this Code. 8 It is the specific intent of this Code that no provision nor term used 9 in this Code is intended to impose any duty whatsoever upon the City or any of its officers or employees, for whom the implementation or 10 enforcement of this Code shall be discretionary and not mandatory. 11 Nothing contained in this Code is intended to be nor shall be construed to create or form the basis for any liability on the part of the 12 City, or its officers, employees or agents, for any injury or damage resulting from the failure of a building to comply with the provisions of 13 this Code, or by reason or in consequence of any inspection, notice, order, certificate, permission or approval authorized or issued or done in 14 connection with the implementation or enforcement of this Code, or by reason of any action or inaction on the part of the City related in any 15 manner to the enforcement of this Code by its officers, employees or agents. 16 17 Section 20: That Section 201(c) of the Uniform Mechanical Code is hereby 18 amended by deleting: 19 (c) Right of Entry. Whenever it is necessary to make an 20 inspection to enforce the provisions of this code, or whenever the building official or his authorized representative has reasonable cause to believe 21 that there exists in any building or upon any premises any condition or violations of this code which make the building or premises unsafe, 22 dangerous or hazardous, the building official or his authorized representative may enter the building or premises at all reasonable times 23 to inspect or to perform the duties imposed upon the building official by this code, provided that if such building or premises be occupied he shall 24 present his credentials to the occupant and request entry. If such building or premises be unoccupied, he shall first make a reasonable effort to 25 locate the owner or other person having charge or control of the building or premises and request entry. If entry is refused the building official or 26 his authorized representative, he shall have recourse to every remedy provided by law to secure entry. 27 When the building official or his authorized representative shall have first obtained a proper inspection warrant or other remedy provided 28 by law to secure entry, no owner or occupant or person having charge, care or control of any building or premises shall fail or neglect, after 29 proper request is made as herein provided, to promptly permit entry therein by the building official or his authorized representative for the 30 purpose of inspection and examination pursuant to this code. 31 32 -8-
