• • ORDINANCE NO. 77 '-ff An Ordinance establishing a set of Rules and Procedures for the processing of application for development under the provisions of the Shoreline Management Act. WHEREAS, it is in the best interest of the City of Everett and its Citizens to establish an orderly and efficient set of rules and procedures for the processing and review of applications for development under the provisions of the Shoreline Manage- ment Act. NOW, THEREFORE, the City does ordain: Section 1: This ordinance hereinafter shall be known as the "Shoreline Permit Proce- dures Ordinance," and may be cited as such. Section 2: PURPOSE: The purpose of this ordinance is to establish an orderly, efficient and clearly understood set of rules and procedures for the review and processing of substantial development, conditional use and variance permit applications under the provisions of the Shoreline Management of 1971 (R.C.W. 90.58.140 (3) and the City of Everett's Shoreline Master Program. Section 3: DEFINITIONS: The following definitions are applicable to this Ordinance; A. Act means the Shoreline Management Act of 1971, Chapter 90.58 RCW. B. Development means a use, consisting of the construction or exterior alteration of structures; dredging; drilling; dumping; filling; removal of any sand, gravel or minerals; bulkheading; driving of piling; placing of obstructions; or any project of a permanent or temporary nature which interferes with the normal public use of the surface of the waters overlying lands subject to the act at any state of water level. C. Hearings Board means the Shoreline Hearings Board established by the Act. D. Master Program means the Shoreline Master Program for the City of Everett, including the regulations together with maps, diagrams, charts or other descriptive material and text, a statement of desired goals and standards developed in accordance with the policies enunciated in Section 2 of the Shoreline Management Act of 1971.
