• <br /> • <br /> ORDINANCE NO. 77 '-ff <br /> An Ordinance establishing a set of <br /> Rules and Procedures for the processing of <br /> application for development under the <br /> provisions of the Shoreline Management Act. <br /> WHEREAS, it is in the best interest of the City of Everett and its Citizens to <br /> establish an orderly and efficient set of rules and procedures for the processing and <br /> review of applications for development under the provisions of the Shoreline Manage- <br /> ment Act. <br /> NOW, THEREFORE, the City does ordain: <br /> Section 1: This ordinance hereinafter shall be known as the "Shoreline Permit Proce- <br /> dures Ordinance," and may be cited as such. <br /> Section 2: PURPOSE: The purpose of this ordinance is to establish an orderly, <br /> efficient and clearly understood set of rules and procedures for the review and processing <br /> of substantial development, conditional use and variance permit applications under <br /> the provisions of the Shoreline Management of 1971 (R.C.W. 90.58.140 (3) and the <br /> City of Everett's Shoreline Master Program. <br /> Section 3: DEFINITIONS: The following definitions are applicable to this Ordinance; <br /> A. Act means the Shoreline Management Act of 1971, Chapter 90.58 RCW. <br /> B. Development means a use, consisting of the construction or exterior alteration <br /> of structures; dredging; drilling; dumping; filling; removal of any sand, <br /> gravel or minerals; bulkheading; driving of piling; placing of obstructions; <br /> or any project of a permanent or temporary nature which interferes with <br /> the normal public use of the surface of the waters overlying lands subject <br /> to the act at any state of water level. <br /> C. Hearings Board means the Shoreline Hearings Board established by the <br /> Act. <br /> D. Master Program means the Shoreline Master Program for the City of <br /> Everett, including the regulations together with maps, diagrams, charts <br /> or other descriptive material and text, a statement of desired goals and <br /> standards developed in accordance with the policies enunciated in Section <br /> 2 of the Shoreline Management Act of 1971. <br />
