• <br /> E. Ordinary High-Water Mark means the mark on Silver Lake, the Snohomish <br /> River, and Port Gardner Bay, which will be found by examining the beds <br /> and banks, and ascertaining where the presence and action of waters are <br /> so common and usual, and so long continued in all ordinary years; as to <br /> mark upon the soil a character distinct from that of the abutting upland, <br /> in respect to vegetation, as that condition exists on the effective date <br /> off this chapter (June, 1971) or as it may naturally change thereafter: <br /> PROVIDED, that in any area where the ordinary high-water mark adjoining <br /> saltwater shall be the line of mean higher high tide and the ordinary high- <br /> water mark adjoining freshwater shall be the line of mean high water. <br /> F. Within the Scope and Intent of the Original Permit shall be construed <br /> to mean that the size value of the authorized project will remain essen- <br /> tially constant or be reduced. Consistent with this design, changes in- <br /> volving no additional environmental impacts may be included. <br /> G. Shoreline Permit means that required by the Shoreline Management Act <br /> for Substantial Development, Conditional Use or Variance on Shorelines, <br /> to be issued by the City of Everett and subject to review by the Depart- <br /> ment of Ecology and the Attorney General. <br /> H. Shorelines means all the water areas of the City and their associated <br /> wetlands under jurisdiction of the Shoreline Act, together with the land <br /> underlying them, including: <br /> 1. That portion of Silver Lake within the corporate limits of the City <br /> and at least 200 feet upland from ordinary high-water mark. (The <br /> associated wetland area.) <br /> 2. That portion from Weyerhaeuser Mill A to the fuel storage tanks <br /> at Mukilteo lying between the extreme low tide and the ordinary <br /> high-water mark and at least 200 feet upland from the ordinary <br /> high-water mark (and the associated wetland areas). <br /> Shorelines of State-Wide Significance within the City of Everett consist <br /> of: <br /> 1. All of the water area of Port Gardner Bay lying seaward of the line <br /> of extreme low tide, out of the City limits in mid-channel. <br /> 2. The Snohomish River and its associated wetlands at least 200 feet <br /> upland of ordinary high-water mark. <br /> -2- <br />
